Her Majesty, in exercise of the powers conferred by paragraph 13 of Part II of Schedule 7 and paragraph 10 of Part II of Schedule 6 to the Merchant Shipping Act 1995(1), is pleased by and with the advice of Her Privy Council to order, and it is ordered, as follows:

Citation and commencement

1.  This Order may be cited as the Limitation of Liability for Maritime Claims (Parties to Convention) Order 1986 and the Carriage of Passengers and their Luggage by Sea (Parties to Convention) Order 1987 (Revocation) Order 2014 and comes into force on 28th May 2014.

Revocation of orders

2.  The following orders are revoked—

(a) the Limitation of Liability for Maritime Claims (Parties to the Convention) Order 1986(2); and

(b) the Carriage of Passengers and their Luggage by Sea (Parties to Convention) Order 1987(3).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order revokes the Limitation of Liability for Maritime Claims (Parties to the Convention) Order 1986 (“the 1986 Order”) and the Carriage of Passengers and their Luggage by Sea (Parties to Convention) Order 1987 (“the 1987 Order”).

The 1986 Order listed the states that were parties to the Convention on Limitation of Maritime Claims 1976 (“the 1976 Convention”) as at 16th December 1986. The 1986 Order had not been amended to include changes since that date.

The 1987 Order listed the states that were parties to the Athens Convention on the Carriage of Passengers and their Luggage by Sea, 1974 (“the 1974 Convention”) as at 18th May 1987. The 1987 Order had not been amended to include changes since that date. The United Kingdom has denounced the 1974 Convention as a consequence of it having ratified the 2002 Protocol to the Athens Convention with effect from 23rd April 2014.

S.I.1986/2224. Following the repeal and re-enactment of Schedule 4 to the Merchant Shipping Act 1979 (c.39) this order has effect as if made under Schedule 7 to the Merchant Shipping Act 1995.

S.I. 1987/931. Following the repeal and re-enactment of Schedule 3 to the Merchant Shipping Act 1979 this order has effect as if made under Schedule 6 to the Merchant Shipping Act 1995.
