The European Union (Future Relationship) Act 2020 (Commencement No. 3) Regulations 2023

The Secretary of State makes these Regulations in exercise of the powers conferred by section 40(7) of the European Union (Future Relationship) Act 2020(1).

Citation and extent

1.—(1) These Regulations may be cited as the European Union (Future Relationship) Act 2020 (Commencement No. 3) Regulations 2023.

(2) These Regulations extend to England and Wales, Scotland and Northern Ireland.

Provision coming into force on 31st December 2023

2.  Paragraph 14 of Schedule 2 to the European Union (Future Relationship) Act 2020 (passenger name record data) comes into force on 31st December 2023.

Explanatory Note

(This note is not part of the Regulations)

These Regulations are the third commencement regulations made under the European Union (Future Relationship) Act 2020 (c. 29) (“the Act”).

Regulation 2 brings paragraph 14 of Schedule 2 to the Act into force on 31st December 2023. This provision amends the Passenger Name Record Data and Miscellaneous Amendments Regulations 2018 (S.I. 2018/598) to reflect the end of the interim period provided by Article 552(11) of the Trade and Cooperation Agreement (see section 37(1) of the European Union (Future Relationship) Act 2020 in relation to the expression “the Trade and Cooperation Agreement”).

The Trade and Cooperation Agreement can be found at https://www.gov.uk/government/publications/ukeu-and-eaec-trade-and-cooperation-agreement-ts-no82021 and hard copies be obtained on request from the Foreign, Commonwealth and Development Office, King Charles Street, London, SWIA 2AH.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector or community bodies is foreseen.
