Deddf Gwasanaethau Cymdeithasol a Llesiant (Cymru) 2014, Croes Bennawd: Asesu oedolion yn gyfredol gyda’r holl newidiadau y gwyddys eu bod mewn grym ar neu cyn 26 Tachwedd 2024. Mae newidiadau a all gael eu dwyn i rym yn y dyfodol. Mae newidiadau a wnaed yn ymddangos yn y cynnwys a chyfeirir atynt trwy anodiadau.
Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.
(1)Pan fo’n ymddangos i awdurdod lleol y gall fod ar oedolyn anghenion am ofal a chymorth, rhaid i’r awdurdod asesu—
(a)a oes ar yr oedolyn anghenion am ofal a chymorth, a
(b)os oes, beth yw’r anghenion hynny.
(2)Mae’r ddyletswydd o dan is-adran (1) yn gymwys o ran—
(a)oedolyn sy’n preswylio fel arfer yn ardal yr awdurdod, a
(b)unrhyw oedolyn arall sydd o fewn ardal yr awdurdod.
(3)Mae’r ddyletswydd o dan is-adran (1) yn gymwys ni waeth beth yw barn yr awdurdod lleol ar—
(a)lefel anghenion yr oedolyn am ofal a chymorth, neu
(b)lefel adnoddau ariannol yr oedolyn.
(4)Wrth wneud asesiad o anghenion o dan yr adran hon, rhaid i’r awdurdod lleol—
(a)ceisio canfod y canlyniadau y mae’r oedolyn yn dymuno eu sicrhau mewn bywyd o ddydd i ddydd,
(b)asesu a allai darparu—
(i)gofal a chymorth,
(ii)gwasanaethau ataliol, neu
(iii)gwybodaeth, cyngor neu gynhorthwy,
gyfrannu at sicrhau’r canlyniadau hynny neu fel arall ddiwallu’r anghenion a nodir gan yr asesiad, ac os felly, i ba raddau, ac
(c)asesu a allai materion eraill gyfrannu at sicrhau’r canlyniadau hynny neu fel arall ddiwallu’r anghenion hynny, ac os felly, i ba raddau.
(5)Rhaid i awdurdod lleol, wrth iddo wneud asesiad o anghenion o dan yr adran hon, gynnwys—
(a)yr oedolyn, a
(b)pan fo’n ddichonadwy, unrhyw ofalwr sydd gan yr oedolyn.
(6)Natur yr asesiad o anghenion sy’n ofynnol gan yr adran hon yw un y mae’r awdurdod lleol yn barnu ei fod yn gymesur o dan yr amgylchiadau, yn ddarostyngedig i unrhyw ofyniad mewn rheoliadau o dan adran 30.
Gwybodaeth Cychwyn

(1)Os yw oedolyn (neu, pan fo’n gymwys, person awdurdodedig) yn gwrthod asesiad o’i anghenion o dan adran 19, nid yw’r ddyletswydd o dan yr adran honno i asesu anghenion yr oedolyn yn gymwys.
(2)Ond nid yw gwrthodiad o dan is-adran (1) yn rhyddhau awdurdod lleol o’i ddyletswydd o dan adran 19 yn yr achosion a ganlyn—
ACHOS 1 - mae’r awdurdod lleol wedi ei fodloni, yn achos gwrthodiad a roddir gan yr oedolyn—
nad oes gan yr oedolyn alluedd i benderfynu a wrthoda gael yr asesiad, ond
bod person awdurdodedig i wneud y penderfyniad ar ran yr oedolyn;
ACHOS 2 - mae’r awdurdod lleol wedi ei fodloni, yn achos gwrthodiad a roddir gan yr oedolyn—
nad oes gan yr oedolyn alluedd i benderfynu a wrthoda gael yr asesiad,
nad oes person awdurdodedig i wneud y penderfyniad ar ran yr oedolyn, ac
y byddai cael yr asesiad er lles pennaf yr oedolyn;
ACHOS 3 - mae’r awdurdod lleol yn amau bod yr oedolyn yn cael, neu’n wynebu risg o gael, ei gam-drin neu ei esgeuluso.
(3)Pan fo awdurdod lleol wedi ei ryddhau o’i ddyletswydd o dan adran 19 drwy wrthodiad o dan yr adran hon, ailymrwymir i’r ddyletswydd—
(a)os yw’r oedolyn (neu, pan fo’n gymwys, person awdurdodedig) yn gofyn wedyn am asesiad, neu
(b)os yw’r awdurdod lleol o’r farn bod anghenion neu amgylchiadau’r oedolyn wedi newid,
(yn ddarostyngedig i unrhyw wrthodiad pellach o dan yr adran hon).
(4)Yn yr adran hon ystyr “person awdurdodedig” yw person sydd wedi ei awdurdodi o dan Ddeddf Galluedd Meddyliol 2005 (p’un ai yn nhermau cyffredinol neu benodol) i benderfynu a wrthoda asesiad o anghenion ar ran yr oedolyn neu a ofynna am asesiad o anghenion ar ei ran.
