Changes to Legislation

Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.

193Adennill costau rhwng awdurdodau lleolLL+C

(1)Mae is-adran (2) yn gymwys—

(a)pan fo awdurdod lleol (“awdurdod A”) yn darparu neu yn trefnu gofal a chymorth i berson sy’n preswylio fel arfer yn ardal awdurdod lleol arall (“awdurdod B”), a

(b)pan fo’r gofal a’r cymorth wedi eu darparu naill ai—

(i)i ddiwallu anghenion brys er mwyn diogelu llesiant y person, neu

(ii)gyda chydsyniad awdurdod B.

(2)Caiff awdurdod A adennill oddi wrth awdurdod B unrhyw dreuliau rhesymol a dynnwyd ganddo wrth ddarparu neu drefnu’r gofal a’r cymorth.

(3)Pan fo awdurdod lleol yn darparu llety o dan adran 76(1) i blentyn a oedd (yn union cyn iddo ddechrau gofalu am y plentyn) yn preswylio fel arfer yn ardal awdurdod lleol arall [F1neu awdurdod lleol yn Lloegr], caiff adennill oddi wrth yr awdurdod arall hwnnw unrhyw dreuliau rhesymol a dynnwyd ganddo wrth ddarparu’r llety a chynnal y plentyn.

(4)Mae is-adran (5) yn gymwys pan fo awdurdod lleol (“awdurdod A”) yn darparu llety o dan adran 77(1) neu (2)(a) neu (b) i blentyn sy’n preswylio fel arfer yn ardal awdurdod lleol arall [F2neu awdurdod lleol yn Lloegr] (“awdurdod B”) ac nad yw’n cynnal y plentyn mewn—

(a)cartref cymunedol a ddarparwyd gan awdurdod A,

(b)cartref cymunedol a reolir, neu

(c)ysbyty sydd wedi ei freinio yng Ngweinidogion Cymru, Ymddiriedolaeth GIG, Ymddiriedolaeth Sefydledig GIG neu’r Ysgrifennydd Gwladol, neu unrhyw ysbyty arall a roddwyd ar gael yn unol â threfniadau a wnaed gan Fwrdd Iechyd Lleol, Ymddiriedolaeth GIG, Ymddiriedolaeth Sefydledig GIG, Gweinidogion Cymru, yr Ysgrifennydd Gwladol, Bwrdd Comisiynu’r Gwasanaeth Iechyd Gwladol neu grŵp comisiynu clinigol.

(5)Caiff awdurdod A adennill oddi wrth awdurdod B unrhyw dreuliau rhesymol a dynnwyd ganddo wrth ddarparu’r llety a chynnal y plentyn.

(6)Ac eithrio lle y bo [F3“is-adran (7) neu (8)] yn gymwys, pan fo awdurdod lleol yn cydymffurfio ag unrhyw gais o dan adran 164(1) neu (2) [F4, neu o dan adran 27(2) o Ddeddf Plant 1989 (cydweithredu rhwng awdurdodau),] mewn perthynas â pherson nad yw’n preswylio fel arfer yn ei ardal, caiff adennill unrhyw dreuliau rhesymol a dynnwyd ganddo mewn cysylltiad â’r person hwnnw oddi wrth yr awdurdod lleol [F5neu awdurdod lleol yn Lloegr] y mae’r person yn preswylio fel arfer yn ei ardal.

(7)Pan fo awdurdod lleol (“awdurdod A”) yn cydymffurfio ag unrhyw gais o dan adran 164(1) neu (2) gan awdurdod lleol arall (“awdurdod B”) mewn perthynas â pherson ac awdurdod B yw’r awdurdod lleol cyfrifol o fewn ystyr adran 104 ar gyfer y person hwnnw, caiff awdurdod A adennill oddi wrth awdurdod B unrhyw dreuliau rhesymol a dynnwyd ganddo wrth arfer ei swyddogaethau o dan adrannau 105 i 115 mewn cysylltiad â’r person hwnnw.

[F6(8)Pan fo awdurdod lleol (“awdurdod A”) yn cydymffurfio ag unrhyw gais o dan adran 27(2) o Ddeddf Plant 1989 (cydweithredu rhwng awdurdodau) gan awdurdod lleol yn Lloegr (“awdurdod B”) mewn perthynas â pherson—

(a)ac awdurdod B yw ei awdurdod cyfrifol (o fewn ystyr Rhan 3 o’r Ddeddf honno) at ddibenion adran 23B neu 23C o’r Ddeddf honno, neu

(b)y mae awdurdod B yn ei gynghori neu’n ymgyfeillio ag ef neu y mae’n rhoi cynhorthwy iddo yn rhinwedd adran 24(5)(a) o’r Ddeddf honno,

caiff awdurdod A adennill oddi wrth awdurdod B unrhyw dreuliau rhesymol a dynnwyd ganddo wrth arfer ei swyddogaethau o dan adrannau 105 i 115 o’r Ddeddf hon mewn cysylltiad â’r person hwnnw.]
