Deddf Gwasanaethau Cymdeithasol a Llesiant (Cymru) 2014, Adran 98 yn gyfredol gyda’r holl newidiadau y gwyddys eu bod mewn grym ar neu cyn 14 Tachwedd 2024. Mae newidiadau a all gael eu dwyn i rym yn y dyfodol. Mae newidiadau a wnaed yn ymddangos yn y cynnwys a chyfeirir atynt trwy anodiadau.
Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Cofnodir newidiadau ac effeithiau gan ein tîm golygyddol mewn rhestrau sydd i'w gweld yn yr adran 'Newidiadau i Ddeddfwriaeth'. Whole provisions yet to be inserted into this Act (including any effects on those provisions):
(1)Rhaid i awdurdod lleol sy’n gofalu am blentyn benodi person annibynnol i fod yn ymwelydd ar gyfer y plentyn os—
(a)yw’r plentyn yn dod o fewn categori a bennwyd mewn rheoliadau, neu
(b)mewn unrhyw achos arall, yr ymddengys i’r awdurdod y byddai gwneud hynny’n fuddiol i’r plentyn.
(2)Rhaid i berson a benodir o dan yr adran hon ymweld â’r plentyn, ymgyfeillio ag ef a’i gynghori.
(3)Y mae hawlogaeth gan berson a benodir o dan yr adran hon i adennill oddi wrth yr awdurdod penodi unrhyw dreuliau rhesymol a dynnir gan y person hwnnw at ddibenion ei swyddogaethau o dan yr adran hon.
(4)Daw penodiad person fel ymwelydd yn unol â’r adran hon i ben—
(a)os yw’r plentyn bellach wedi peidio â derbyn gofal gan yr awdurdod lleol,
(b)os bydd y person yn ymddiswyddo drwy roi hysbysiad ysgrifenedig i’r awdurdod penodi, neu
(c)os bydd yr awdurdod yn rhoi hysbysiad ysgrifenedig i’r person ei fod wedi terfynu’r penodiad.
(5)Nid yw dod â phenodiad o’r fath i ben yn effeithio ar unrhyw ddyletswydd o dan yr adran hon i wneud penodiad pellach.
(6)Pan fo awdurdod lleol yn cynnig penodi ymwelydd ar gyfer plentyn o dan yr adran hon, ni chaniateir gwneud y penodiad—
(a)os yw’r plentyn yn ei wrthwynebu, a
(b)os yw’r awdurdod yn fodlon bod gan y plentyn ddealltwriaeth ddigonol i wneud gwrthwynebiad deallus.
(7)Pan fo ymwelydd wedi cael ei benodi i’r plentyn o dan yr adran hon, rhaid i awdurdod lleol ddod â’r penodiad i ben—
(a)os yw’r plentyn yn gwrthwynebu bod y penodiad yn parhau, a
(b)os yw’r awdurdod yn fodlon bod gan y plentyn ddealltwriaeth ddigonol i wneud gwrthwynebiad deallus.
(8)Os yw’r awdurdod lleol yn rhoi effaith i wrthwynebiad plentyn o dan is-adran (6) neu (7) a’r gwrthwynebiad yw bod unrhyw un yn cael ei benodi’n ymwelydd ar ei gyfer, nid oes yn rhaid i’r awdurdod gynnig penodi person arall o dan is-adran (1) hyd nes y bydd y gwrthwynebiad wedi ei dynnu yn ôl.
(9)Caiff rheoliadau wneud darpariaeth o ran yr amgylchiadau lle y mae person i’w ystyried at ddibenion yr adran hon fel un sy’n annibynnol ar yr awdurdod penodi.
