Ar hyn o bryd nid oes unrhyw effeithiau heb eu gweithredu yn hysbys ar gyfer y Deddf Rheoleiddio ac Arolygu Gofal Cymdeithasol (Cymru) 2016, Adran 158.
Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. Gweler 'Cwestiynau Cyffredin' am fanylion ynglŷn â'r amserlenni ar gyfer nodi a chofnodi effeithiau newydd ar y safle hwn.
(1)Mae’r adran hon yn gymwys pan fo panel addasrwydd i ymarfer—
(a)ar ôl dyfarnu bod amhariad ar addasrwydd person cofrestredig i ymarfer (“canfyddiad o amhariad”), yn penderfynu peidio â chymryd unrhyw gamau pellach o dan adran 138(5);
(b)yn dilyn canfyddiad o amhariad, yn rhoi rhybudd o dan adran 138(6);
(c)yn dilyn canfyddiad o amhariad, yn gwneud gorchymyn cofrestru amodol o dan adran 138(7);
(d)yn dilyn canfyddiad o amhariad, yn gwneud gorchymyn atal dros dro o dan adran 138(8);
(e)yn dilyn canfyddiad o amhariad, yn gwneud gorchymyn dileu o dan adran 138(9);
(f)yn dilyn canfyddiad o amhariad, yn gwneud penderfyniad mewn achos adolygu o dan adran 152(8) (gwarediadau yn dilyn adolygiad o ymgymeriadau);
(g)yn dilyn canfyddiad o amhariad, yn gwneud penderfyniad mewn achos adolygu o dan adran 153(6), (7) neu (9) (gwarediadau yn dilyn adolygiad o orchymyn cofrestru amodol);
(h)yn dilyn canfyddiad o amhariad, yn gwneud penderfyniad mewn achos adolygu o dan adran 154(6), (7), (8) neu (10) (gwarediadau yn dilyn adolygiad o orchymyn atal dros dro);
(i)yn gwneud penderfyniad mewn achos adolygu o dan adran 155(9) neu (10) (gwarediadau yn dilyn adolygiad o orchymyn atal dros dro amhenodol).
(2)Caiff y person y gwnaed penderfyniad o fath a restrir yn is-adran (1) mewn cysylltiad ag ef apelio i’r tribiwnlys yn erbyn y penderfyniad.
(3)Rhaid i apêl gael ei dwyn o fewn y cyfnod o 28 o ddiwrnodau sy’n dechrau â’r diwrnod y rhoddir hysbysiad o’r penderfyniad i’r person o dan sylw.
(4)Ond caiff y tribiwnlys ganiatáu i apêl gael ei gwneud iddo ar ôl diwedd y cyfnod a grybwyllir yn is-adran (3) os yw wedi ei fodloni bod rheswm da dros y methiant i apelio cyn diwedd y cyfnod hwnnw (a thros unrhyw oedi cyn gwneud cais am ganiatâd i apelio ar ôl yr amser priodol).
(5)Ar apêl o dan yr adran hon, caiff y tribiwnlys—
(a)cadarnhau’r penderfyniad,
(b)rhoi penderfyniad arall y gallai’r panel addasrwydd i ymarfer fod wedi ei wneud yn lle’r penderfyniad y gwneir apêl yn ei erbyn, neu
(c)anfon yr achos yn ôl i GCC i’w waredu yn unol â chyfarwyddydau’r tribiwnlys.
