Animals and Animal Products (Import and Export) (Amendment) Regulations (Northern Ireland) 1997

The Department of Agriculture, being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Economic Community, in exercise of the powers conferred on it by the said section 2(2) and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Animals and Animal Products (Import and Export) (Amendment) Regulations (Northern Ireland) 1997 and shall come into operation on 11th April 1997.

Interpretation

2.  The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to a measure of the Northern Ireland Assembly.

Amendment of the Animals and Animal Products (Import and Export) Regulations (Northern Ireland) 1995 (the principal Regulations)

3.  The Animals and Animal Products (Import and Export) Regulations (Northern Ireland) 1995(4) shall be amended as provided in regulations 4 to 9.

Registration of dealers

4.  At the end of regulation 8 there shall be inserted the following paragraph—

(4) For the purposes of paragraph (1) the Department shall keep a register of dealers engaging in intra-Community trade who have applied for registration in accordance with that paragraph..

Approval of bodies, institutes or centres

5.  At the end of regulation 9 there shall be inserted the following paragraph—

(4) For the purposes of Article 11 of Council Directive 92/65/EEC, the Department shall approve any equine semen collection centre or equine embryo collection team which has applied for that approval in accordance with Article 11 of that Directive and which meets the conditions applicable to it in respect of approval and the performance of its duties as required by Article 11 and Annex D to that Directive..

Illegal consignments

6.  After regulation 13(1) there shall be inserted—

(1A) Where any animal detained or isolated, or any animal product detained, under paragraph (1)(a) has been in contact with any other animal or animal product, the Department may serve a notice on the person appearing to have charge of that other animal or animal product and sub-paragraphs (a) and, as the case may be, (b) or (c) of paragraph (1) shall apply in relation to such an animal or animal product as if it were an animal or animal product mentioned in paragraph (1)..

Post import controls

7.  In regulation 23, after paragraph (2), there shall be inserted—

(3) Where the Department exercises the powers granted under paragraph (2) to place any animal in quarantine or isolation, it may also, by notice served on the person appearing to have charge of any other animal which has been in contact with such an animal, require him to place that other animal in quarantine or isolation at such place as may be specified in the notice..

Community legislation

8.  For Schedules 1, 2 and 4 there shall be substituted respectively the Schedules set out in Schedules 1, 2 and 3 to these Regulations.

Disapplication of legislation

9.  In Schedule 5 for the entry which relates to the Artificial Reproduction of Animals (Northern Ireland) Order 1975(5) there shall be substituted the entry set out in Schedule 4 to these Regulations.

(a)The official health certificate accompanying all cattle exported from Northern Ireland must contain the statement: “Animals in accordance with Commission Decision 94/474/EC of 27th July 1994 concerning bovine spongiform encephalopathy”.

(b)The official health certificate accompanying all cattle imported into Northern Ireland from Spain must contain the statement: “Live cattle in accordance with Commission Decision 90/208/EEC of 18th April 1990 on contagious bovine pleuro-pneumonia”.

(c)The official health certificate accompanying all cattle imported into Northern Ireland from Portugal must contain the statement: “Live cattle in accordance with Commission Decision 91/52/EEC of 14th January 1991 on contagious bovine pleuro-pneumonia”.

(d)The official health certificate accompanying all swine exported from Northern Ireland to Denmark, Finland, or those regions of Austria, France and Germany specified in Commission Decisions amending Decision 93/24/EEC must contain the statement: “Pigs in accordance with Commission Decision 93/24/EEC of 11th December 1992 concerning Aujeszky’s disease. In the case of pigs for breeding, the test used was the whole virus ELISA/ELISA for g1 antibodies (delete where applicable).”

(e)The official health certificate accompanying all cattle exported from Northern Ireland to Denmark or Finland must contain the statement: “Bovines in accordance with Commission Decision 93/42/EEC of 21st December 1992 concerning infectious bovine rhinotracheitis for bovines being sent to Member States or Regions listed in the Annex to the said Decision”.

(f)The official health certificate accompanying all swine exported from Northern Ireland to Luxembourg, Sweden and those regions of Austria and Germany specified in Commission Decision 93/244/EEC must contain one of the following statements:

“Pigs for breeding in accordance with Commission Decision 93/244/EEC”; or

Pigs for production in accordance with Commission Decision 93/244/EEC.

(g)In accordance with Commission Decision 95/108/EC the importation into Northern Ireland from the Italian region of Sardinia of animals of the suidae family is prohibited.

(h)The official health certificate accompanying all cattle exported from Northern Ireland to Austria or Sweden must contain the statement: “Bovines in accordance with Commission Decision 95/109/EC”.

Bovine semen

(b)The importation into Northern Ireland of lagomorphs which cannot be shown to have been born on the holding of origin and kept in captivity since birth is prohibited except in accordance with the provisions of the Rabies (Importation of Dogs, Cats and Other Mammals) Order (Northern Ireland) 1977. Lagomorphs born on the holding of origin and kept in captivity since birth must be accompanied on importation by an official health certificate confirming that status and that the holding of origin has been free from rabies for at least one month.

(c)Animals (other than carnivores, primates, bats and lagomorphs) born on the holding of origin and kept in captivity since birth must be accompanied on importation by a certificate completed by the exporter confirming that status and that the animals do not show any obvious signs of disease at the time of export, and that the premises of origin are not subject to any animal health restrictions.

No. L95, 13.4.88, p. 21). Cattle imported into Northern Ireland from Canada may only be despatched from the territory of Canada between 1st February and 15th April inclusive.

(b)The importation of cattle from herds in which not all bovines over 24 months old have been tested negative for enzootic bovine leukosis within the twelve months prior to the date of export from Canada is permitted subject to the following provisions:

(i)in the case of females, the animals must have been non-pregnant at the time of entry into pre-export isolation and at the time of loading for export;

(ii)in the case of bulls not intended for direct entry into semen collection centres, and in the case of females, the animals must be at least 18 months old at the time of loading for export and must undergo 6 months isolation following import into Northern Ireland;

(iii)in the case of bulls intended for direct entry into a semen collection centre, the animals must undergo 9 months isolation following import into Northern Ireland.

All pre-export tests of registered equidae and equidae for breeding and production imported from Belarus, Bulgaria, Croatia, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, ex-Yugoslav Republic of Macedonia, Montenegro, Poland, Romania, Russia, Serbia, the Slovak Republic, Slovenia and the Ukraine must be carried out as follows: for vesicular stomatitis at the Institute of Animal Health, Pirbright; the mandatory tests for infectious anaemia and the tests of dourine and glanders and, if necessary, the test for equine viral arteritis at the Central Veterinary Laboratory, Weybridge, or at Veterinary Sciences Division, Stoney Road, Belfast. The test results must be attached to the health certificate accompanying the imported equidae.

Croatia

The importation into Northern Ireland from Croatia of domestic animals of the porcine species is prohibited.

Shellfish from third countries for relaying in Community waters

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Animals and Animal Products (Import and Export) Regulations (Northern Ireland) 1995 (“the principal Regulations”) by replacing Schedules 1, 2 and 4 (regulation 8), and amending Schedule 5 to those Regulations to take into account changes in Community legislation since those Regulations were passed (regulation 9).

The Regulations also amend the principal Regulations by—

(a)empowering the Department to approve equine semen collection centres and equine embryo collection teams in accordance with the conditions required by Council Directive 92/65/EEC (regulation 5);

(b)extending the powers of the Department to enable it to detain, slaughter or destroy animals and animal products which have been in contact with animals or animal products which are likely to constitute a serious hazard to public or animal health (regulation 6);

(c)extending the Department’s powers to impose post-import controls by enabling it to require the quarantine or isolation of animals which have come into contact with imported animals (regulation 7).
