The Street Works Register (Registration Fees) Regulations (Northern Ireland) 2003

The Department for Regional Development(1), in exercise of the powers conferred by Article 13(4) of the Street Works (Northern Ireland) Order 1995(2) and now exercisable by it(3) and of every other power enabling it in that behalf hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Street Works Register (Registration Fees) Regulations (Northern Ireland) 2003 and shall come into operation on 1st July 2003.

Interpretation

2.  In these Regulations –

“prescribed information” means the information required to be given by an undertaker to the Department pursuant to regulation 3 of the 2002 Regulations for registration on the register; and

“the register” means the street works register required to be kept by the Department by virtue of Article 13(1) of the Street Works (Northern Ireland) Order 1995; and

“the 2002 Regulations” means the Street Works (Register, Notices, Directions and Designations) Regulations (Northern Ireland) 2002(4).

Registration Fee

3.—(1) Subject to paragraph (2), upon the registration of prescribed information by an undertaker, in accordance with regulation 3 of the 2002 Regulations, that undertaker shall pay to the Department the appropriate fee prescribed in the Schedule.

(2) No fee shall be payable where registration of an item of prescribed information is effected in consequence of its transmission electronically to a computer system maintained by or on behalf of the Department for the purposes of the Northern Ireland Street Works Register and Notification System.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations make provision for the payment of an appropriate fee by an undertaker to the Department on the registration of specified information on the street works register kept by the Department. The Regulations further provide (regulation 3(2)) that no fee is payable where information to be registered on the street works register is transmitted electronically to a computer system maintained by or on behalf of the Department for the purposes of the Northern Ireland Street Works Register and Notification System.
