The Department for Employment and Learning (1), in exercise of the powers conferred on it by Article 5(2) of the Education (Unrecognised Degrees) (Northern Ireland) Order 1988 (2) and now vested in it (3) and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Education (Listed Bodies) (Amendment) (No.2) Order (Northern Ireland) 2005 and shall come into operation on 22nd December 2005.

Amendment of the Education (Listed Bodies) (Northern Ireland) Order 2004

2.  The Education (Listed Bodies) (Northern Ireland) Order 2004 (4) shall be amended as follows.

3.  In Section 1 of Part 1 of the Schedule—

(a)omit—

(i)“Central School of Speech and Drama”;

(ii)“Edge Hill College of Higher Education”;

(iii)“Kent Institute of Art and Design”;

(iv)“Laban Centre, London”;

(v)“Southampton Institute”

(vi)“Surrey Institute of Art and Design University College, The”;

(vii)“York St John College”;

(b)for “Trinity College of Music”, substitute “Trinity Laban”.

4.  In Part 2 of the Schedule, omit—

(a)“University of Wales, Cardiff”; and

(b)“University of Wales, College of Medicine”.

Explanatory Note

(This note is not part of the Order)

Article 3 (1) of the Education (Unrecognised Degrees) (Northern Ireland) Order 1988 (“the 1988 Order”) makes it an offence to grant, offer to grant or issue any invitation relating to certain degrees and awards. This does not apply to anything done in relation to a recognised award. A “recognised award” means –

(a)any award granted or to be granted by a university, college or other body which is authorised by Royal Charter or Act of Parliament to grant degrees; or

(b)any award granted or to be granted by any body for the time being permitted by any body falling within sub-paragraph (a) to act on its behalf in the granting of degrees.

The Education (Listed Bodies) (Northern Ireland) Order 2004 contains the list of the names of each body which is not a recognised body within Article 3 (2) (a) or (b) of the 1998 Order but which either-

(a)provides any course which is in preparation for a degree to be granted by a recognised body and is approved by or on behalf of the recognised body; or

(b)is a constituent college, school, or hall or other institution of a university which is a recognised body.

This Order amends the Education (Listed Bodies) (Northern Ireland) Order 2004 to remove Central School of Speech and Drama, Edge Hill College of Higher Education, Kent Institute of Art and Design, Laban Centre, London, the Southampton Institute, The Surrey Institute of Art and Design, and York St John College from the list of bodies appearing to fall within (a) above. It also removes University of Wales, Cardiff and University of Wales, College of Medicine from the list of bodies appearing to fall within (b) above. It also reflects the fact that Trinity College of Music has changed its name.
