The Department for Social Development, in exercise of the powers conferred on it by Articles 109 and 148(1) of the Housing (Northern Ireland) Order 2003(1) and of every other power enabling it in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Home Repair Assistance Grant (Amendment) Regulations (Northern Ireland) 2010 and shall come into operation on 7 February 2011.
2.—(1) In Regulation 1 (2) of the Home Repair Assistance Grant Regulations (Northern Ireland) 2003(2) after the definition of “housing benefit” add—
“(income related) employment and support allowance” means (income related) employment and support allowance under Part 1 of the Welfare Reform Act (Northern Ireland) 2007;” and
(2) After the definition of “income-based jobseeker’s allowance” omit the definition of “pension credit”.
3. In Regulation 2 of the Home Repair Assistance Grant Regulations (Northern Ireland) 2003 after “is in receipt of” add—
“(income related) employment and support allowance,”.
4. In Paragraph 4 of Schedule 1 to the Home Repair Assistance Grant Regulations (Northern Ireland) 2003 after “is in receipt of” add—
“(income related) employment and support allowance,”.

These Regulations amend the Home Repair Assistance Grant Regulations (Northern Ireland) 2003 which deal with entitlement to home repair assistance under Chapter IV of Part III of the Housing (Northern Ireland) Order 2003, the manner of making an application for such assistance, the content of, and the procedure for dealing with, such applications.
Regulation 2 adds a definition of (income related) employment and support allowance and removes an unnecessary definition on pension credit.
Regulation 3 adds (income related) employment and support allowance to the list of benefits that the Executive must be satisfied the applicant or his partner is in receipt of before entertaining an application for assistance.
Regulation 4 adds (income related) employment and support allowance to the list of benefits which if the applicant or his partner is in receipt of must be included in the application.

Explanatory Memorandum sets out a brief statement of the purpose of a Statutory Rule and provides information about its policy objective and policy implications. They aim to make the Statutory Rule accessible to readers who are not legally qualified and accompany any Northern Ireland Statutory Rule or Draft Northern Ireland Statutory Rule laid before the UK Parliament during the suspension of the Northern Ireland Assembly.
