The Department of Health(1) makes the following Regulations in exercise of the powers conferred by sections 25B(1)(a) and (2)(e) and (g), and 25F(2) of the Public Health Act (Northern Ireland) 1967(2)

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Health Protection (Coronavirus, Public Health Advice for Persons Travelling to Northern Ireland) (No. 2) (Amendment) Regulations (Northern Ireland) 2020 and shall come into operation on 14th December 2020.

(2) In these Regulations, “the principal Regulations” means the Health Protection (Coronavirus, Public Health Advice for Persons Travelling to Northern Ireland) (No. 2) Regulations (Northern Ireland) 2020(3).

Amendment of the Health Protection (Coronavirus, Public Health Advice for Persons Travelling to Northern Ireland) (No. 2) Regulations (Northern Ireland) 2020

2.  The principal Regulations are amended in accordance with regulations 3 and 4.

Amendments to regulation 3

3.  In regulation 3 (requirement to provide information at certain times), after paragraph 8 insert—

(9) If, following the coming into operation of any provision which amends the information required to be provided by regulation 4, an operator provides information to a passenger that would have complied with the information requirement but for the coming into operation of that amending provision, it is a defence for the operator to show that it was not reasonably practicable for the amended information to be provided..

Amendments to the Schedule

4.  In the Schedule—

(a)in Part 1, in point 2 for “14 days” substitute “10 days”;

(b)in Part 2, for “14 days” substitute “10 days”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Health Protection (Coronavirus, Public Health Advice for Persons Travelling to Northern Ireland) (No. 2) Regulations (Northern Ireland) 2020.

The self-isolation period is amended from 14 days to 10 days.

A reasonable defence clause for operators is added.

An impact assessment has not been completed prior to making these Regulations due to their urgent nature. However a screening exercise will be conducted before the regulations come into operation.
