The Department for Infrastructure(1) makes the following Order in exercise of the powers conferred by Article 59(1) of the Road Traffic Offenders (Northern Ireland) Order 1996(2) and now vested in it(3).
In accordance with Article 91(1) of that Order the Department has consulted with such representative organisations as it thinks fit.
1. This Order may be cited as the Road Traffic (Fixed Penalty) (Amendment) Order (Northern Ireland) 2023 and shall come into operation on 15th May 2023.
2. In Schedule 1 to the Road Traffic (Fixed Penalty) Order (Northern Ireland) 2007(4) (fixed penalties), after item 25 insert—
“25A. | A fixed penalty offence under Article 12 of the Road Traffic (Northern Ireland) Order 1995 | £100”. |

This Order amends Schedule 1 to the Road Traffic (Fixed Penalty) Order (Northern Ireland) 2007 by inserting an amount of £100 for the fixed penalty prescribed for the offence under Article 12 of the Road Traffic (Northern Ireland) Order 1995.
The new fixed penalty relates to the offence of driving a mechanically propelled vehicle on a road or other public place without due care and attention, or without reasonable consideration for other persons using the road or place.

Explanatory Memorandum sets out a brief statement of the purpose of a Statutory Rule and provides information about its policy objective and policy implications. They aim to make the Statutory Rule accessible to readers who are not legally qualified and accompany any Northern Ireland Statutory Rule or Draft Northern Ireland Statutory Rule laid before the UK Parliament during the suspension of the Northern Ireland Assembly.
