TITLE CONDITIONS
The Title Conditions (Scotland) Act 2003 (Commencement No. 1) Order 2003
The Scottish Ministers, in exercise of the powers conferred on them by section 129(4) of the Title Conditions (Scotland) Act 2003() and of all other powers enabling them in that behalf, hereby make the following Order:
Citation
1. This Order may be cited as the Title Conditions (Scotland) Act 2003 (Commencement No. 1) Order 2003.
Commencement of provisions
2.—(1) The day appointed for the coming into force of Part 3, except section 43, and sections 106, 107, 109 and 110 of the Title Conditions (Scotland) Act 2003 is 1st November 2003;
(2) The day appointed for the coming into force of sections 43 and 108 of the Title Conditions (Scotland) Act 2003 is 28th November 2004.

Explanatory Note
The Title Conditions (Scotland) Act 2003 (“the Act”) received Royal Assent on 3rd April 2003. Section 129(3) of the Act specifies the provisions which came into force on the day after Royal Assent.
This order brings into force on 1st November 2003 provisions of the Act relating to conservation burdens, maritime burdens, economic development burdens, health care burdens and the compulsory acquisition of land or the acquisition of land where compulsory powers could have been used.
The provisions of the Act which come into force on 28th November 2004 relate to rural housing burdens and the amendment of the Church of Scotland (Property and Endowments) (Amendment) Act 1933.
