The Scottish Ministers, in exercise of the powers conferred by sections 66(1), 74A and 84 of the Agriculture Act 1970 M1 after consultation as required by section 84(1) of that Act with such persons or organisations appearing to represent the interests concerned, and in exercise of the powers conferred by section 2(2) of the European Communities Act 1972 M2 (in so far as these Regulations cannot be made under the powers of the Agriculture Act 1970 above) and of all other powers enabling them in that behalf, hereby make the following Regulations:

M11970 c. 40; section 66(1) was amended by S.I. 1982/980, 1995/1412, 1996/1342 and 1999/1663. Section 74A was inserted by the European Communities Act 1972, (c.68), Schedule 4, paragraph 6. Section 66(1) contains definitions of “the Ministers”, “prescribed” and “regulations”. The functions of the Secretary of State in so far as within devolved competence were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).

M21972 c. 68; section 2(2) was amended by the Scotland Act 1998 (c. 46), Schedule 8, paragraph 15(3). The function conferred upon Ministers of the Crown by section 2(2), in so far as within devolved competence, was transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998.

Citation, commencement and extentS

1.—(1) These Regulations may be cited as the Feeding Stuffs (Scotland) Amendment (No. 3) Regulations 2003 and shall come into force on 1st December 2003.

(2) These Regulations extend to Scotland only.

Amendment of the Feeding Stuffs (Scotland) Regulations 2000S

2.  Schedule 3 (permitted additives and provisions relating to their use) to the Feeding Stuffs (Scotland) Regulations 2000 M3 shall be amended as follows:–

(a)for the provisions specified in Part II of the Table (permitted colourants), there shall be substituted the provisions set out in Schedule 1 to these Regulations; and

(b)for the provisions specified in Part IX of the Table (European Community Regulations by which additives are controlled), there shall be substituted the provisions set out in Schedule 2 to these Regulations M4.

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which extend to Scotland only, further amend the Feeding Stuffs (Scotland) Regulations 2000 (S.S.I. 2000/453, as already amended).

These Regulations implement Commission Directive 2003/7/EC amending the conditions for authorisation of canthaxanthin in feedingstuffs in accordance with Council Directive 70/524/EEC (O.J. No. L 22, 25.1.03, p.28).

These Regulations also provide for the enforcement of the following Community Regulations:–

(a)

Commission Regulation (EC) No. 871/2003 permanently authorising a new additive manganomanganic oxide in feedingstuffs (O.J. No. L 125, 21.5.03, p.3); and

(b)

Commission Regulation (EC) No. 877/2003 provisionally authorising the use of the acidity regulator “Benzoic acid” in feedingstuffs (O.J. No. L 126, 22.5.03, p.24).

These Regulations amend the Feeding Stuffs (Scotland) Regulations 2000 by–

(a)

modifying the controls regulating the presence of additives in feedingstuffs by specifying new maximum levels in feed for the colourant canthaxanthin in Part II of the Table to Schedule 3 (regulation 2(a) and Schedule 1); and

(b)

adding two new Commission Regulations to the list of Commission Regulations under which authorisation for the marketing of feed additives has been granted which is contained in Part IX of the Table to Schedule 3 (regulation 2(b) and Schedule 2).

A Regulatory Impact Assessment, which includes a compliance assessment of the effect which these Regulations would have on business costs, has been prepared in relation to these Regulations and has been placed in the Scottish Parliament Information Centre.
