Coming into force in accordance with regulation 1
The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 150(1) of the Children’s Hearings (Scotland) Act 2011(1) and sections 17 and 31 of the Children (Scotland) Act 1995(2), and all other powers enabling them to do so.
In accordance with sections 150(3) and 197(2) of the Children’s Hearings (Scotland) Act 2011 a draft of this instrument has been laid before, and approved by resolution of, the Scottish Parliament.
1995 c.36. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46); section 17 was amended by schedule 2, paragraph 9 of the Adoption and Children (Scotland) Act 2007 (asp 4) and prospectively by schedule 5, paragraph 2(4) of the Children’s Hearings (Scotland) Act 2011. The powers to make these Regulations are exercised together by virtue of section 33(2) of the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10). These Regulations are subject to the affirmative procedure by virtue of section 33(3) of that Act.

They aim to make the Scottish Statutory Instrument accessible to readers who are not legally qualified and accompany any Scottish Statutory Instrument or Draft Scottish Statutory Instrument laid before the Scottish Parliament from July 2012 onwards. Prior to this date these type of notes existed as ‘Executive Notes’ and accompanied Scottish Statutory Instruments from July 2005 until July 2012.
