The Minister of Agriculture, Fisheries and Food and the Secretary of State for Social Services, acting jointly, in exercise of the powers conferred on them by sections 4 and 123 of the Food and Drugs Act 1955, as read with the Secretary of State for Social Services Order 1968(1), and of all other powers enabling them in that behalf, hereby make the following regulations after consultation with such organisations as appear to them to be representative of interests substantially affected by the regulations:—
1.—(1) These regulations may be cited as the Arsenic in Food (Amendment) Regulations 1973, and shall come into operation on 14th July 1973.
(2) The Interpretation Act 1889 shall apply to the interpretation of these regulations as it applies to the interpretation of an Act of Parliament.
2. The Arsenic in Food Regulations 1959(2), as amended(3), shall be further amended by substituting for sub-paragraph (d) of regulation 3(2) thereof the following sub-paragraph:—
“(d)to any food in respect of which the maximum permitted arsenic content is prescribed by any regulations, other than these regulations or any amendment to these regulations, made under the Food and Drugs Act 1955 or by any other having effect as if contained in regulations so made.”.

These Regulations, which come into operation on 14th July 1973, amend the Arsenic in Food Regulations 1959 as amended by the Colouring Matter in Food Regulations 1966 (S.I. 1966/1203). They extend exemption from arsenic limits already specified, to food for which the maximum permitted arsenic content is prescribed by any other instrument made, or having effect as if made, under the Food and Drugs Act 1955.
