SALMON AND FRESHWATER FISHERIES

The Secretary of State, having received relevant proposals, having taken into consideration the need for conservation, having been satisfied that there will be a significant increase in the availability of fishing for freshwater fish in the prescribed area and that such fishing will be available therein as specified in section 1(3)(c) of the Freshwater and Salmon Fisheries (Scotland) Act 1976((1)), having carried out all necessary consultations, having directed publication of the proposals and having considered all representations and objections duly made and not withdrawn, as required by section 1(1) and (3) of, and paragraphs 1 to 4 and 5(1) of Schedule 1 to, the said Act, in exercise of the powers conferred on him by section 1 of that Act, and all other powers enabling him in that behalf, hereby makes the following Order:
1. This Order may be cited as the West Strathclyde Protection Order 1988 and shall come into force on 7th October 1988.
2. In this Order, “the map” means the map marked “Area of the West Strathclyde Protection Order 1988”, signed on behalf of the Secretary of State for Scotland and deposited in the principal office of the Department of Agriculture and Fisheries for Scotland in Edinburgh.
3. Fishing for or taking freshwater fish in inland waters in the area prescribed in article 4 hereof, without legal right or without written permission from a person having such a right, is hereby prohibited.
4. The prescribed area shall consist of the catchment areas in Strathclyde Region of the Rivers Annick, Irvine, Gogo Water, Noddsdale Water and certain other waters, and that part of the catchment area of the River Garnock which excludes the waters below the march fence to the south of Dalgarven Mill at Ordnance Survey NS 2965-4564 and the Lugton Water below the footbridge at Montgreenan Mains at Ordnance Survey NS 3417-4490 to its confluence with the River Garnock, and is delineated by a continuous blue line on the map.

This Order prohibits the fishing for or taking of freshwater fish in inland waters in the area prescribed, without legal right or written permission from someone having that right.
The prescribed area is the whole of the catchment area of the Rivers Annick, Irvine, Gogo Water, Noddsdale Water and certain other waters and part of the catchment area of the River Garnock, all in Strathclyde Region. It is defined by reference to a detailed large scale map which may be inspected at the principal office of the Department of Agriculture and Fisheries for Scotland in Edinburgh, on any working day between 8.30 a.m. and 4.30 p.m.
The map annexed to and forming part of this note gives a general guide to the boundaries of the prescribed area.
