The Secretary of State for Transport, in exercise of the powers conferred by sections 54(1) and 61 of the Road Traffic Act 1988(1) and of all other enabling powers, and after consultation with representative organisations in accordance with section 195(2) of the Road Traffic Act 1988, hereby makes the following Regulations:—

Citation and commencement

1.  These Regulations may be cited as the Motor Vehicles (Type Approval) (Great Britain) (Amendment) Regulations 1990 and shall come into force on 21st February 1990.

Amendment

2.—(1) The Table in Part II of Schedule 1B of the Motor Vehicles (Type Approval) (Great Britain) Regulations 1984(2) shall be amended as follows.

(2) In the entry relating to item 4C in Schedule 1, for paragraph 2 in column (2) and the entries relating to that paragraph in columns (3) and (4) there shall be substituted—

“2. Other vehicles propelled by spark ignition engines, with a maximum gross weight of:—
(a) not more than 2000 kg,	See Schedule 1 Item 4C	See Schedule 1 Item 4C	30.9.1990	30.9.1991
(b) more than 2000 kg and not more than 3500 kg,	See Schedule 1 Item 4C	See Schedule 1 Item 4C	30.9.1992	30.9.1993
(c)more than 3500 kg	1.10.1990	1.10.1990	—	—”

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Motor Vehicles (Type Approval) (Great Britain) Regulations 1984 by correcting a drafting error in previous amending Regulations.

The Motor Vehicles (Type Approval) (Great Britain) (Amendment) Regulations 1989 (S.I. 1989/1580) (amongst other things) substituted a new item 4C in Schedule 1 to the 1984 Regulations.

It was intended that the exhaust emission requirements set out in that item should not apply to vehicles with spark ignition engines and which have a gross weight of more than 3,500 kg until 1st October 1990. These Regulations give effect to that intention.

The entry relating to item 4C in the Table in the Explanatory Note to S.I. 1989/1580 should read:

• “New so far as the requirement applies to vehicles with diesel engines and to vehicles with spark ignition engines and which have a gross weight of more than 3,500 kg”.
