The Secretary of State, being designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the conferment and protection of exclusive rights in the topographies of semiconductor products, in exercise of the powers conferred on him by the said section 2(2) hereby makes the following Regulations:—

1.  These Regulations may be cited as the Design Right (Semiconductor Topographies) (Amendment) Regulations 1991 and shall come into force on 30th October 1991.

2.  The Schedule to the Design Right (Semiconductor Topographies) Regulations 1989(3) shall be amended by substituting for Parts II and III thereof the Parts II and III set out in the Schedule to these Regulations.

Explanatory Note

(This note is not part of the Regulations)

These Regulations replace Parts II and III of the Schedule to the Design Right (Semiconductor Topographies) Regulations 1989 with two new Parts to show the current position on the additional classes of qualifying persons enjoying legal protection of topographies of semiconductor products. The addition of Australia to the Part II countries and the transfer of the French overseas territories from Part III to Part II give effect to Council Decision 90/510/EEC (O.J. No. L285, 17.10.90, page 29). The United States of America and Switzerland are included by virtue of Commission Decision 90/541/EEC (O.J. No. L307, 7.11.90, page 21) and Council Decision 90/511/EEC (O.J. No. L285, 17.10.90, page 31).
