The A564 Trunk Road (Stoke—Derby Route) (Derby Southern Bypass, Derby Spur and Junctions) Order 1992

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:—

1.  The new highways which the Secretary of State proposes to construct—

(a)along the route described in Schedule 1 to this Order (the highway along this route being in this Order referred to as “the main new trunk road”); and

(b)along the routes described in Schedule 2 to this Order which connect the main new trunk road with other highways at the places stated in that Schedule (the highways along these routes being in this Order referred to as “the slip roads”),

shall become trunk roads as from the date when this Order comes into force.

2.  The centre line of each of the new trunk roads is indicated by a heavy black line on the deposited plan.

3.  The Secretary of State directs as respects any part of a highway which crosses the route of any of the new trunk roads that—

(a)where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority; and

(b)where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,

until, in either case, a date to bespecified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for the purpose of through traffic.

4.  In this Order—

(1) except where otherwise expressly provided, all measurements of distance are measured along the route of the relevant highway;

(2) (i) “the deposited plan” means the plan numbered HA10/EM71 marked “The A564 Trunk Road (Stoke— Derby Route) (Derby Southern Bypass, Derby Spur and Junctions) Order 1992”, signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

(ii)“the main new trunk road” have the meanings given in article 1 of this and “the slip roads” Order;

(iii)“the new trunk roads” means the highways mentioned in article 1 of this Order;

(iv)“the main A564 Trunk Road” means the new trunk road which the Secretary of State proposes to construct pursuant to article 1(a) of the A564 TrunkRoad (Stoke—Derby Route) (Derby Southern Bypass and Slip Roads) (No. 2)Order 1992;

(v)“the A6 Trunk Road” means the A6 London—Inverness Trunk Road; and

(vi)“the A5111 Trunk Road” means the A5111 Nottingham—Derby—Stoke-on-Trent Trunk Road.

5.  This Order shall come into force on 14th February 1992 and may be cited as the A564 Trunk Road (Stoke—Derby Route) (Derby Southern Bypass, Derby Spur and Junctions) Order 1992.

SCHEDULE 1ROUTE OF THE MAIN NEW TRUNK ROAD

The route of the main new trunk road is at Alvaston and Stocker Flat in the City of Derby and the Parishes of Elvaston and Aston upon Trent in the County of Derbyshire. It starts with a roundabout, the centre of which is at a point (given the reference letter "A' on the deposited plan) on the A5111 Trunk Road (Raynesway) about 150 metres north of its junction with Alvaston Street and runs eastwards then south-eastwards to the east of St. John Fisher Primary School, through Stocker Flat and across Elvaston Lane, then southwards to cross the A6 Trunk Road and includes a roundabout, the centre of which is at a point about 360 metres north-west of the junction of the driveway to Elvaston Castle and the A6 Trunk Road and 80 metres south-west of the A6 Trunk Road, to connect with the A6 Trunk Road. It then continues southwards crossing Snelsmoor Lane west of Thulston and terminates at a point (given the reference letter "B' on the deposited plan) about 830 metres south of the junction of Snelsmoor Laneand the A6 Trunk Road.

The route is about 3.80 kilometres long.

SCHEDULE 2ROUTES OF THE SLIP ROADS

1.  A route to carry two-way traffic to the slip roads given the reference numbers 2and 3 on the deposited plan, starting at a point (given the reference letter "B' on the deposited plan)and terminating at a point (given the reference letter "C' on the deposited plan) about 450 metres south-west of the junction of the driveway to Fox Covert Farm and Derby Road. This route is given the reference number 1 on the deposited plan.

2.  A route to connect the southbound carriageway of the route described at item (1) of this Schedule with the westbound carriageway of the main A564 TrunkRoad. This route is given the reference number 2 on the deposited plan.

3.  A route to connect the westbound carriageway of the main A564 Trunk Road with the northbound carriageway of the route described at item (1) of this Schedule. This route is given the reference number 3 on the deposited plan.

4.  A route to connect the southbound carriageway of the main new trunk road with the eastbound carriageway of the main A564 Trunk Road. This route is given the reference number 4 on the deposited plan.

5.  A route to connect the eastbound carriageway of the main A564 Trunk Road with the northbound carriageway of the route described at item (1) of this Schedule. This route is given the reference number 5 on the deposited plan.
