The Friendly Societies Act 1992 (Commencement No.2) Order 1992

The Treasury, in exercise of the powers conferred upon them by section 126(2) of the Friendly Societies Act 1992(1), and of all other powers enabling them in that behalf, hereby makes the following Regulations:

1.  This Order may be cited as the Friendly Societies Act 1992 (Commencement No.2) Order 1992.

2.  The following provisions of the Friendly Societies Act 1992 shall come into force on 1st January 1993—

(i) section 84 (disputes under the National Savings Bank Act 1971(2) and the National Debt Act 1972(3));

(ii) section 120(1) (amendments) to the extent necessary to bring into force the provisions of Part I of Schedule 21 specified in the following paragraph; and

(iii) In Part I of Schedule 21, paragraphs 2 to 4.

3.  Where a dispute to which section 10(1) of the National Savings Bank Act 1981 applies was referred to the Registrar before 1 January 1993 or where a dispute to which section 5(1) of the National Debt Act 1972 applies was referred to the Chief Regsitrar of friendly societies or a deputy appointed by him or to the assistant registrar of friendly societies for Scotland, before 1st January 1993 that dispute shall be treated as if it had been referred to the adjudicator appointed under section 84 of the Friendly Societies Act 1992 and any thing done in relation to such a dispute by the Registrar or the Chief Registrar, any deputy appointed by him or the assistant registrar of friendly societies for Scotland shall be treated as a thing done by the adjudicator.

Explanatory Note

(This note is not part of the Regulations)

This Order brings into force on 1st January 1993 section 84 of the Friendly Societies Act 1992 which transfers the jurisdiction of the Chief Registrar of friendly societies, a deputy appointed by him or an assistant registrar of friendly societies to hear the disputes described in section 10(1) of the National Savings Bank Act 1971 and in section 5(1) of the National Debt Act 1972 to an adjudicator appointed by the Treasury. It also brings into force necessary consequential amendments.
