The Secretary of State for Transport, in exercise of the powers conferred by sections 3(3) and 4(4) and (5) of the Vehicle Excise and Registration Act 1994(1) and of all other powers enabling him in that behalf, hereby makes the following Order:—

Citation and commencement

1.  This Order may be cited as the Vehicle Licences (Duration of First Licences and Rate of Duty) (Amendment) Order 1994 and shall come into force on 1st January 1995.

Revocation

2.  The Vehicle Licences (Duration of First Licences and Rate of Duty) (Northern Ireland) Order 1986(2) is hereby revoked.

Amendment of 1986 Order

3.—(1) The Vehicle Licences (Duration of First Licences and Rate of Duty) Order 1986(3) shall be amended as follows.

(2) The following article shall be inserted after article 1—

“Extent

1A.   This Order shall extend to England, Wales, Scotland and Northern Ireland.”

(3) In article 2—

(a) for the words “the Vehicles (Excise) Act 1971” in paragraph (1) there shall “the Vehicle Excise and Registration Act 1994 (“the 1994”)”;

(b) for the words “section 13 of the Act of 1971” in paragraph (2)(a) there shall be substituted “section 9 of the 1994 Act”;

(c) the word “or” immediately following paragraph (2)(a) shall be omitted; and

(d) paragraph (2)(b) shall be omitted.

(4) In article 3(1)(b) for “£35” there shall be substituted “£50”.

(5) The following paragraph shall be substituted for paragraph (a) of article 4—

“(a) an amount ascertained in accordance with section 4 of the 1994 Act;”.

(6) The first two lines of numbers given in the table in the Schedule shall be revised as follows—

Explanatory Note

(This note is not part of the Order)

This Order amends the Vehicle Licences (Duration of First Licences and Rate of Duty) Order 1986. That Order is extended to Northern Ireland in place of the Vehicle Licences (Duration of First Licences and Rate of Duty) (Northern Ireland) Order 1986, which is revoked. There is an increase of £1 in each case in the rates at which additional vehicle excise duty is payable where the first licence for a vehicle (for which the annual rate of duty does not exceed £300) is taken out for a period of 6 or 12 months plus a period beginning on the 10th, 17th or 24th day of the first month. This is the first increase in these rates since October 1986. References to repealed legislation are updated.
