The Sheriff Court Districts (Alteration of Boundaries) Order 1996

The Secretary of State, in exercise of the powers conferred on him by sections 3 and 43(1) of the Sheriff Courts (Scotland) Act 1971(1) and all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Sheriff Court Districts (Alteration of Boundaries) Order 1996 and shall come into force on 1st April 1996.

(2) In column 3 of Schedule 1 to this Order—

“area” means the area of a council constituted under section 2 of the Local Government etc. (Scotland) Act 1994(2);

“ward” means an electoral ward specified by the Secretary of State in a direction made under paragraph 1(1) of Schedule 2 to the Local Government etc. (Scotland) Act 1994 for the purposes of the elections held under section 5(2) of that Act.

Alteration of boundaries of sheriff court districts

2.—(1) On 1st April 1996, the boundaries of the sheriff court districts of—

(a)Airdrie;

(b)Arbroath;

(c)Dundee;

(d)Forfar;

(e)Glasgow and Strathkelvin; and

(f)Perth,

shall be altered, but all other sheriff court districts existing immediately before that date shall continue in existence without alteration of their boundaries.

(2) In consequence of paragraph (1) above—

(a)the six sheriffdoms of Scotland (as specified in column 1 of Schedule 1 to this Order) shall continue to be divided into the sheriff court districts specified in column 2 of that Schedule;

(b)each of those districts shall on and after 1st April 1996 comprise the area specified in column 3 of that Schedule opposite the name of the district in question; and

(c)sheriff courts shall continue to be held in each sheriff court district at the place specified in column 4 of that Schedule opposite the name of the district in question.

Revocations

3.  The Orders specified in Schedule 2 to this Order are hereby revoked.

Explanatory Note

(This note is not part of the Order)

The Sheriff Court Districts Reorganisation Order 1975 (“the 1975 Order”) divided Scotland’s six sheriffdoms into 50 sheriff court districts (one of which was subsequently abolished). This Order alters the boundaries of 6 of these districts with effect from 1st April 1996.

Under the Sheriffdoms (Alteration of Boundaries) Order 1996 (S.I. 1996/1006), an area around Chryston is to be transferred from the sheriffdom of Glasgow and Strathkelvin into the sheriffdom of South Strathclyde, Dumfries and Galloway. This Order makes the consequential transfer of that area from the sheriff court district of Glasgow and Strathkelvin into the sheriff court district of Airdrie. The other changes involve the transfer of three areas from the sheriff court district of Dundee into the sheriff court districts of Arbroath, Forfar and Perth. All changes made by the Order are linked to the reorganisation of local government areas in Scotland which takes effect on 1st April 1996.

Since the 1975 Order specified the areas of sheriff court districts for the most part by reference to the areas of district and islands councils (which bodies are to be abolished as at 1st April 1996), that Order is now revoked and Schedule 1 to this Order specifies the sheriff court district areas for the most part by reference to new local authority areas and electoral wards.
