Whereas the Council for Professions Supplementary to Medicine has, in accordance with the provisions of section 10(1) of the Professions Supplementary to Medicine Act 1960(1), recommended to the Privy Council that the Act should extend to the profession of prosthetist and orthotist:

And whereas a draft of this Order has been laid before Parliament and approved by resolution of each House:

Now, therefore, Their Lordships, in exercise of the powers conferred on Them by section 10(2) of the Act, and all other powers enabling Them in that behalf, after consulting, as boards appearing to Them to be concerned, all the boards established under the Act and existing on the day on which this Order is made, are pleased to order, and it is hereby ordered, as follows—

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Professions Supplementary to Medicine (Prosthetists and Orthotists Board) Order of Council 1997 and shall come into force on the day after the day on which it is made.

(2) In this Order, “the Act” means the Professions Supplementary to Medicine Act 1960.

Extension of application of the Act to the profession of prosthetist and orthotist

2.  The Act shall have effect as if the profession of prosthetist and orthotist were mentioned in section 1(2) of the Act, and accordingly the First Schedule to the Act (constitutions of the Council and boards, and supplementary provisions) shall have effect as if there were made the further alterations, additions or omissions specified in the Schedule to this Order.

Article 2.

SCHEDULE

Alterations, additions and omissions in the First Schedule to the Act

1.  Part I of the First Schedule to the Act (Constitutions of the Council and Boards, and Supplementary Provisions) shall have effect as if—

(a)in paragraph 1(1), for the word “twenty-one” there were substituted the word “twenty-four”;

(b)in paragraph 1(1)(b), for the word “three” there were substituted the word “five”, and for the words “one only shall be a registered medical practitioner” there were substituted the words “two only shall be registered medical practitioners”;

(c)in paragraph 1(1)(c), for the word “seven” there were substituted the word “eight”;

(d)in paragraph 3(2), for the words “the profession of orthoptists” there were substituted the words “the professions of orthoptist and of prosthetist and orthotist”; and

(e)after paragraph 3(3) there were added the following sub-paragraph—

(4) Before making an appointment under this paragraph as respects the profession of prosthetist and orthotist the said Ministers shall consult the British Association of Prosthetists and Orthotists.

2.  Part II of the First Schedule to the Act (Constitution of the Boards) shall have effect as if—

(a)in the table at the end of paragraph 4(1), after the line relating to membership of the Physiotherapists Board there were inserted, under the headings indicated, the following entries in relation to the Prosthetists and Orthotists Board—

(b)after paragraph 7(4) there were added the following sub-paragraph—

(4A) Of the three members of the Prosthetists and Orthotists Board appointed in pursuance of the said paragraph (d)—

(a)one shall be a member of the teaching staff of a university department concerned with the teaching of prosthetics and orthotics;

(b)one shall be a member of a body which represents the interests of employers of prosthetists and orthotists; and

(c)the other shall be a member of a body which represents the interests of patients of prosthetists and orthotists or of carers of such patients (or of both).; and

(c)after paragraph 7(5) there were added the following sub-paragraph—

(6) Without prejudice to the generality of sub-paragraph (5), before making any appointment to which paragraph (b) or (c) of sub-paragraph (4A) relates, the Council shall consult any persons or bodies which appear to the Council, after it has consulted the Secretary of State, to represent the interests of—

(a)in the case of an appointment to which paragraph (b) of sub-paragraph (4A) relates, employers of prosthetists and orthotists; or

(b)in the case of an appointment to which paragraph (c) of sub-paragraph (4A) relates, patients of prosthetists and orthotists and carers of such patients.;

(d)in paragraph 8(3), for the words “sub-paragraph (2) or sub-paragraph (3)” there were substituted the words “sub-paragraph (2), (3) or (4)”.

Explanatory Note

(This note is not part of the Order)

This Order extends the Professions Supplementary to Medicine Act 1960 to the profession of prosthetist and orthotist. The Order has the effect, in consequence of that extension, of establishing the Prosthetists and Orthotists Board. It makes amendments to that Act in relation to the composition of the Council for Professions Supplementary to Medicine, and makes specific provision in respect of the composition of the Prosthetists and Orthotists Board.

1960 c. 66. The Act was extended to the profession of orthoptists by S.I. 1966/990, and ceased to extend to the profession of remedial gymnasts by virtue of S.I. 1986/630. The First Schedule to the Act has effect as if amended by both instruments.
