The Secretary of State, in exercise of the powers conferred on him by sections 1(1) and (2) and 24(1) and (3) of the Food and Environment Protection Act 1985(1) and of all other powers enabling him in that behalf, hereby makes the following Order:
1.—(1) This Order may be cited as the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) Partial Revocation Order 1998 and shall come into force on 21st January 1998.
(2) In this Order, “the principal Order” means the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) Order 1991(2).
2.—(1) The principal Order is revoked so far as it designates any part of the areas set out in Schedule 1 to this Order.
(2) Part II of Schedule 1 to the principal Order shall be amended in accordance with Schedule 2 to this Order.

Article 2(1)
1. Dumfries and Galloway Region
The area of land within the former Wigtown District, now Dumfries and Galloway Council area, comprising that part of the Parish of Minnigaff bounded as follows:—
On the north-west from the point of intersection between the Cross Burn and the northern boundary between the Dumfries and Galloway Council area and South Ayrshire Council area (formerly the boundary between Dumfries and Galloway Region and Strathclyde Region) in an easterly direction following said boundary and the boundary between Dumfries and Galloway Council area and East Ayrshire Council area until it meets the former boundary between Wigtown District and Stewartry District at point national grid reference NX467873; then in a southerly direction following the western boundary of the unnamed forestry plantation and the boundary between the former Wigtown District and Stewartry District to point national grid reference NX476816; then in a generally westerly, northerly, and southerly direction following the eastern, northern and western boundaries of Ellergower Knowe Plantation until it meets Loch Dee; then following the northern, western and southern banks of Loch Dee to the White Laggan Burn; then following the line of the said Burn in a southerly direction to point national grid reference NX458761; then in a southerly direction to the point of intersection with the Stronbae Hill Plantation at point national grid reference NX458756; then following the boundary of the said Plantation in a southerly then westerly, then northerly direction to point national grid reference NX450764; then in a north-easterly direction to spot height 674 on the Curleywee; then in a north-westerly direction to point national grid reference NX446788 on the Glenhead Burn; then a westerly direction following the line of the said Burn to the point of intersection with the Glentrool Forest; then in a north-westerly and westerly direction following the north-eastern boundary of Glentrool Forest to the east bank of Loch Trool at point national grid reference NX422800, then in a generally westerly direction following the east and north banks of Loch Trool to point national grid reference NX409800; then following the eastern boundary of Glentrool Forest in a generally northerly, westerly, southerly and again northerly direction to the point of intersection between the Cross Burn and the northern boundary of Dumfries and Galloway Council area with South Ayrshire Council area.
2. Strathclyde Region
The area of land within Kilmarnock and Loudoun District and comprising that part of the Parish of Galston bounded as follows:—
On the north from point national grid reference NS615366 continuing in a north-easterly direction by the course of the old railway until it meets the boundary between East Kilbride District and Kilmarnock and Loudoun District; and then continuing in a south-easterly and westerly direction by said boundary to point national grid reference NS619364 and continuing in a north-westerly direction to point national grid reference NS618367; then in a south-westerly direction to point national grid reference NS615366 and continuing in a north-westerly direction by the minor road until it meets the course of the old railway at point national grid reference NS615366.
Article 2(2)
1. For paragraph 2(c) of Part II of Schedule 1 to the principal Order there shall be substituted the following:—
“(c)The area of land within the former Cumnock and Doon Valley District, now East Ayrshire Council area, comprising that part of the Parish of Auchinleck bounded as follows:—
On the north on the boundary between the Parishes of Muirkirk and Auchinleck at spot height 418 at point national grid reference NS675224; then continuing in an easterly direction along said boundary until it meets the western boundary of Drummond’s Knowe Plantation; then following the western boundary of the said Plantation in a south-westerly direction until it meets the boundary between the Parishes of Auchinleck and New Cumnock; then continuing in a westerly direction by the said boundary to point national grid reference NS697180; then continuing in a north westerly direction to point national grid reference NS695184; then continuing in a westerly direction to the summit of Black Hill at spot height 428 then continuing in a westerly direction to the summit of Benalt at spot height 381; then continuing in a north-westerly direction to point national grid reference NS668190; then continuing in a northerly direction to point national grid reference NS668197 on Glenmuir Water; then continuing in a generally westerly direction following the south bank of Glenmuir Water to its point of intersection with the boundary between the Parishes of Auchinleck and Old Cumnock at point national grid reference NS646193; then continuing along said boundary in a generally westerly direction to point national grid reference NS636195; then continuing in a northerly direction to point national grid reference NS636198; then continuing in a westerly direction to the small plantation at point national grid reference NS633198 and then continuing by the eastern and northern boundaries of the small plantation to point national grid reference NS634202; and then in a north-westerly direction to point national grid reference NS629215; then in a north-easterly direction to the Glass Water at point national grid reference NS637227; then in a generally south-easterly direction following the said Glass Water to point national grid reference NS646224; then in a north-easterly direction to point national grid reference NS650225; then in an easterly direction to spot height 418 at point national grid reference NS675224.”.
2. For paragraph 3(a) of Part II of Schedule 1 to the principal Order there shall be substituted the following:—
“(a)The area of land within the former Stirling District, now Stirling Council area, comprising that part of the Parish of Killin bounded as follows:—
On the north from point national grid reference NN509369 on the River Lochay in the south-easterly direction along the said River to point national grid reference NN537355; then continuing in a south-westerly direction by the western bank of Lochan nan Damh to point national grid reference NN520330; then continuing in an easterly direction to the summit of Meall Clachach at spot height 603; then continuing in a generally easterly and southerly direction to the boundary of the Monemore Plantation at point national grid reference NN556325; then continuing in a generally south-easterly direction following the boundary of the said Plantation to its southernmost point; then continuing in a south-easterly direction to the River Dochart; then in a south-westerly direction, following the line of the said River Dochart, to point of intersection with an unnamed burn at point national grid reference NN508287; then in a south-easterly direction following the line of said unnamed burn to the point of intersection with the Road A85; then in a north-easterly and south-easterly direction, following the line of said Road, to the point of intersection with the boundary between the Parishes of Killin and Balquhidder, then continuing in a south-westerly direction by said boundary to point national grid reference NN494230; then continuing in a northerly direction to the Luib Burn; then continuing in a northerly direction following the line of the said Luib Burn to the point of intersection with the River Dochart; then following the line of the south bank of the said River Dochart in a westerly direction to the point of intersection with the Allt Riobain Burn; then in a northerly direction following said Burn to point national grid reference NN454322; then in a north-easterly direction to the summit of Meall a Churain at spot height 917; then in a north-easterly direction to the summit at spot height 881; then in an easterly direction to the summit at spot height 864; then in a south-easterly direction to the summit at spot height 766; then continuing generally in a northerly direction to and by the Allt Dubhchlair Burn until it meets the River Lochay at point national grid reference NN509369.”.
3. For paragraph 3(b) of Part II of Schedule 1 to the principal Order there shall be substituted the following:—
“(b)The area of land within the former Stirling District, now Stirling Council area, comprising that part of the Parish of Balquhidder bounded as follows:—
On the north from point national grid reference NN532244 continuing generally in a north-easterly direction until it meets the boundary between the Parishes of Balquhidder and Kenmore; then continuing in a southerly direction by said boundary until the point of intersection with the junction of the Road A85 and Road A84 at Lochearnhead; then continuing in a westerly direction to the disused railway at point national grid reference NN585238; then continuing in a generally southerly and westerly direction following said disused railway to the point of intersection with the Auchtubhmore Hill Plantation; then continuing along the line of the northern boundary of the said Plantation to point national grid reference NN559217; and then continuing in a north-westerly direction to the summit of Meall an t-Seallaidh and then continuing in a north-westerly direction to point national grid reference NN532244.”.

This Order partially revokes the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) Order 1991 which contains emergency prohibitions restricting various activities in order to prevent human consumption of food which has been, or which may have been, rendered unsuitable for that purpose in consequence of the escape of radioactive substances from a nuclear reactor situated at Chernobyl in the Ukraine.
This Order reduces the area subject to restriction.
1985 c. 48; section 1 was amended by section 51 of the Food Safety Act 1990 (c. 16). Section 1(2) defines “designating authority” and section 24(1) contains a definition of “the Ministers” relevant to the exercise of the statutory powers under which this Order is made.
