The Secretary of State, in exercise of the powers conferred on her by section 120(1) of the Customs and Excise Management Act 1979(1), hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Origin of Goods (Petroleum Products) (Revocation) Regulations 2002 and shall come into force on 1st October 2002.

Revocation

2.  The Origin of Goods (Petroleum Products) Regulations 1988(2) and the Origin of Goods (Petroleum Products) (Amendment) Regulations 1992(3) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations)

These Regulations revoke the Origin of Goods (Petroleum Products) Regulations 1988. Those Regulations laid down the conditions under which certain petroleum products specified in the Schedule to the Regulations were to be treated as originating in a particular country for the purposes of preferential rates of, or exemption from, customs duties charged in accordance with section 5(1) and (2) of the European Communities Act 1972. At the time of the making of those Regulations there were no Community origin rules for these products.

These Regulations also revoke the Origin of Goods (Petroleum Products) (Amendment) Regulations 1992. As a result of those amendment Regulations, which reflected the changes given effect by Council Regulation (EEC) No. 3576/92 and by Commission Regulation (EEC) No. 3660/92 amending Commission Regulations (EEC) No. 693/88, (EEC) No. 809/88 and (EEC) No. 343/92, the principal Regulations provided for rules of origin for petroleum products from the overseas countries and territories (as associated with the Community by Article 182 of the EC Treaty (formerly Article 131) and listed in Annex II (formerly Annex IV) to that Treaty) of the Member States of the European Community only.

Annex III of Council Decision (EC) No. 2001/822 on the association of the overseas countries and territories with the European Community (OJ L314, 30.11.2001, p.1) and Appendix 2 thereto (OJ L324, 7.12.2001, p.1), which entered into force on 31 December 2001, now provide Community origin rules for petroleum products from the overseas countries and territories.
