The Secretary of State, with the consent of the Treasury(1), in exercise of the powers conferred on him by sections 1 to 7 of the Police Pensions Act 1976(2), and after taking into consideration the recommendations of the Police Negotiating Board for the United Kingdom and supplying that Board with a draft of these Regulations in accordance with section 62(1) of the Police Act 1996(3), hereby makes the following Regulations:
1.—(1) These Regulations may be cited as the Police Pensions (Additional Voluntary Contributions) (Amendment) Regulations 2003 and shall come into force on 15th November 2003.
(2) These Regulations extend to England and Wales.
2.—(1) Regulation 17 of the Police Pensions (Additional Voluntary Contributions) Regulations 1991(4) shall be amended as follows.
(2) In paragraph (1)(a) for the words “within the meaning of the Police Act 1964” there shall be substituted “maintained under section 2 of the Police Act 1996, the metropolitan police force, the City of London police, the Director General of the National Crime Squad, the Director General of the National Criminal Intelligence Service, a police member of the National Crime Squad appointed under section 55(1)(b) of the Police Act 1997(5) or a police member of the National Criminal Intelligence Service appointed under section 9(1)(b) of the Police Act 1997(6)”.

These Regulations amend regulation 17 of the Police Pensions (Additional Voluntary Contributions) Regulations 1991 to update a statutory reference and provide that any appeals under those Regulations by the Director General of the National Crime Squad, a police member of that Squad, the Director General of the National Criminal Intelligence Service or a police member of that Service shall be to the Crown Court.
The functions of the Minister for the Civil Service were transferred to the Treasury by the Transfer of Functions (Minister for the Civil Service and Treasury) Order 1981 (S.I. 1981/1670).
1996 c. 16; section 62(1) was amended by sections 90(3) and 91(3) of the Police Reform Act 2002 (c. 30).
S.I. 1991/1304; to which there have been amendments not relevant to the subject matter of these Regulations.
1997 c. 50; section 55 is amended by section 87 of the Police Reform Act 2002: there have been other amendments to section 55 which are not relevant to the subject matter of these Regulations.
Section 9 is prospectively amended by section 86 of the Police Reform Act 2002: there have been other amendments to section 9 which are not relevant to the subject matter of these Regulations.
