The Secretary of State for Environment, Food and Rural Affairs, in exercise of the powers conferred upon her by section 15 of the Social Security Act 1990(1) and with the consent of the Treasury, makes the following Regulations:
1. These Regulations may be cited as the Home Energy Efficiency Scheme (England) (Amendment) Regulations 2004 and come into force on 15th October 2004.
2. In regulation 4(1)(e) of the Home Energy Efficiency Scheme (England) Regulations 2000(2) for the figure “£14,200” substitute “£14,600”.

These Regulations amend the Home Energy Efficiency Scheme (England) Regulations 2000 (S.I. 2000/1280, as amended) in regulation 4(1)(e) so as to raise the threshold of the relevant income for the purposes of the eligibility to apply for a grant for the improvement of energy efficiency in their dwellings of persons in receipt of child tax credit or working tax credit which includes a disability element from £14,200 to £14,600.
1990 c. 27; section 15 was amended by section 142 of the Housing Grants, Construction and Regeneration Act 1996 (c. 53). The functions of the Secretary of State under section 15 are, so far as exercisable in or as regards Scotland, devolved to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). As regards Wales, those functions are exercisable by the National Assembly for Wales concurrently with the Secretary of State; see the reference to the Social Security Act 1990 in Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672).
