Whereas the Secretary of State for Education and Skills has received a proposal from the Learning and Skills Council for England, made in accordance with section 51 of the Further and Higher Education Act 1992(1) (“the Act”), for the dissolution under section 27 of the Act of the further education corporations known as Tynemouth College and North Tyneside College(2) (“the corporations”);
Now, therefore, in exercise of the powers conferred on him by section 27 of the Act, the Secretary of State, after consulting the corporations and with the consent of the further education corporation known as Tyne Metropolitan College(3), hereby makes the following Order:
1. This Order may be cited as the Tynemouth College and North Tyneside College (Dissolution) Order 2005 and shall come into force on 1st March 2005.
2. On 1st March 2005 the corporations shall be dissolved and all of their property, rights and liabilities shall be transferred to Tyne Metropolitan College, being a body corporate established for purposes which include the provision of educational facilities or services.
3. Section 26(2), (3) and (4) of the Act shall apply to any person employed by the corporations immediately before 1st March 2005 as if the references in that section –
(a)to a person to whom that section applies were to a person so employed;
(b)to the operative date were to 1st March 2005;
(c)to the transferor were to the corporations; and
(d)to the corporation were to Tyne Metropolitan College.

This Order dissolves with effect from 1st March 2005 the further education corporations established to conduct Tynemouth College and North Tyneside College. It provides for the transfer of their property, rights and liabilities to Tyne Metropolitan College and secures the rights of their employees by applying section 26(2) to (4) of the Further and Higher Education Act 1992.
