The Secretary of State for Education and Skills has consulted the General Teaching Council for England in accordance with section 42(9) of the Teaching and Higher Education Act 1998(1) and, in exercise of the powers conferred by sections 4(2)(ba), 4A and 42(6) of that Act, makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the General Teaching Council for England (Registration of Teachers) (Amendment) Regulations 2007 and come into force on 31^st July 2007.

Amendment of S.I. 2000/2176

2.  After regulation 4 of the General Teaching Council for England (Registration of Teachers) Regulations 2000(2) insert—

“Service of notice of Council’s decision on application

4A.   The Council shall serve notice on an applicant for registration of its decision to grant or refuse the application and, in the case of a refusal, of the grounds on which the decision was taken and, where applicable, of the applicant’s right to appeal against the decision under regulation 4B.

Appeals against refusal of registration on grounds of suitability

4B.   Any person aggrieved by a decision made on relevant grounds to refuse an application made by him for registration under section 3 of the 1998 Act has the right of appeal against that decision to the High Court within 28 days from the date on which notice of the decision is served on him.”

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the General Teaching Council for England (Registration of Teachers) Regulations 2000 (“the principal Regulations”) and come into force on 31^st July 2007.

They provide for notice to be served on an applicant for registration of the Council’s decision, of the grounds for refusal, where appropriate, and of the right of appeal against the decision, where applicable (new regulation 4A of the principal Regulations).

They also confer on any person aggrieved by a decision to refuse his application for registration, on the ground that at the relevant time the Council were not satisfied as to his suitability to be a teacher, a right of appeal to the High Court against that decision (new regulation 4B of the principal Regulations). The reference in new regulation 4B to a decision made on relevant grounds is a reference to a decision made on the ground that at the relevant time, the Council were not satisfied of the applicant’s suitability to be a teacher; the meaning is given in section 4A(2) of the Teaching and Higher Education Act 1998 (c. 30).

A full impact assessment has not been produced for this instrument as no direct impact on the private or voluntary sectors is foreseen.
