The Secretary of State makes the following Order in exercise of the powers conferred by sections 14(6) and 22A(2) of the Football Spectators Act 1989(1):

The Secretary of State considers that the provision made by article 2 of this Order is expedient in order to secure the effective enforcement of Part II of that Act.

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Football Spectators (2008 European Championship Control Period) Order 2008 and shall come into force on 19th May 2008.

(2) In this Order—

“the Tournament” means the external tournament known as the UEFA (Union of European Football Associations) EURO 2008 European Championship finals tournament in Austria and Switzerland, and

“Part II” means Part II of the Football Spectators Act 1989.

Control Period

2.  Section 14(6) of the Football Spectators Act 1989 shall have effect in relation to the Tournament as if, for the reference to five days, there were substituted a reference to ten days.

3.—(1) In relation to the Tournament, the period described in paragraph (2) below is a control period for the purposes of Part II.

(2) The period referred to in paragraph (1) above is the period beginning on 28th May 2008, being ten days before the day of the first football match which is included in the Tournament, and ending when the last match included in the Tournament is finished (which, subject to postponement, is due to be on 29th June 2008) or cancelled.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order describes the control period under the Football Spectators Act 1989 for the UEFA (Union of European Football Associations) EURO 2008 European Championship finals tournament in Austria and Switzerland. The control period begins on 28th May 2008, being ten days before the first match in the tournament, and ends when the last match in the tournament is finished or cancelled. The last match is due to be played on 29th June 2008.

During a control period the powers contained in sections 19 (requirements for those subject to banning orders to report to a police station and surrender passports) and 21A and 21B (summary powers to detain and refer to a court with a view to making a banning order) of the 1989 Act are exercisable.

1989 c.37. Section 14 was substituted, together with sections 14A to 14J, for existing sections 14 to 17 by paragraph 2 of Schedule 1 to the Football (Disorder) Act 2000 (c.25). Section 22A was inserted by paragraph 18 of Schedule 2 to that Act and has been amended by Schedule 5 to the Violent Crime Reduction Act 2006 (c.38) and section 39(2) of the Identity Cards Act 2006 (c.15) although the latter amendment has not come into force.
