The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by section 135 of the Education Act 2002(1):
1. These Regulations may be cited as the Education (Head Teachers’ Qualifications) (England) (Revocation) Regulations 2012 and come into force on 8th February 2012.
2. The Regulations listed in the first column of the Schedule are revoked.

These Regulations revoke the Education (Head Teachers’ Qualifications) (England) Regulations 2003 (and amending Regulations). Those Regulations made provision, from 1st April 2004, for first-time head teachers of maintained schools and non-maintained special schools in England to hold the National Professional Qualification for Headship (NPQH) or its equivalent in Wales, Scotland or Northern Ireland. The Regulations did not apply to persons who had been appointed as head teachers before they came into force. Special provision was also made for persons appointed before 1st April 2009.
With the revocation of the Regulations, it will no longer be compulsory for an individual to hold the NPQH or an equivalent qualification before being appointed to the position of head teacher in any school.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sector is foreseen.
