The Secretary of State, in exercise of the powers conferred by sections 71 and 104(1) of the Control of Pollution Act 1974(1), makes the following Order:
1. This Order—
(a)may be cited as the Control of Noise (Code of Practice on Noise from Ice-Cream Van Chimes Etc.) (England) Order 2013;
(b)extends to England and Wales but applies in relation to England only; and
(c)comes into force on 1st October 2013.
2. For the purpose of giving guidance on appropriate methods for minimising noise from loudspeakers fixed to vehicles used for the conveyance and sale to the public of a perishable commodity for human consumption, the Secretary of State has prepared, and approves and issues, the code of practice entitled “Code of Practice on Noise from Ice-Cream Van Chimes Etc. in England 2013”(2).
3. The Control of Noise (Code of Practice on Noise from Ice-Cream Van Chimes Etc.) Order 1981 is revoked(3).

This Order (which applies to England) approves a code of practice which has been prepared by the Secretary of State for Environment, Food and Rural Affairs to give guidance on methods for minimising noise from loudspeakers fixed to vehicles used for the conveyance and the sale to the public of a perishable commodity for human consumption (ice-cream van chimes).
This Order replaces, in England, the Control of Noise (Code of Practice on Noise from Ice-Cream Van Chimes Etc) Order 1981 (S.I. 1981/1828).
A full impact assessment of the effect that this instrument will have on the costs of business, the voluntary sector and the public sector is published with the Explanatory Memorandum alongside the instrument on http://www.legislation.gov.uk.
The code of practice is entitled “Code of Practice on Noise from Ice-Cream Van Chimes Etc in England 2013” and may be downloaded from the Department for Environment, Food and Rural Affairs website at https://www.gov.uk.
