The governing bodies of the West Earlham Infant School(1) and the West Earlham Junior School(2) (“the Schools”), qualifying bodies for the purposes of Chapter 1 of Part 1 of the Education Act 2002(3) (“the Act”) have, in accordance with section 4(2) of the Act, consulted the local authority and such persons as appear to them to be appropriate, including the parents of the registered pupils at the Schools and the staff working at the Schools.

It is the opinion of the Secretary of State pursuant to section 1(1)(a) of the Act, having regard to the matters set out in section 1(2), that the implementation by the Schools’ governing bodies of the provisions of this Order may contribute to the raising of educational standards in England.

In exercise of the powers conferred by section 2(1) of the Act, the Secretary of State, on the application of the Schools’ governing bodies, makes the following Order.

Citation and commencement

1.  This Order may be cited as the West Earlham Infant School and West Earlham Junior School (School Day and School Year Regulations) Order 2013 and comes into force on 8th April 2013.

Relaxation of the Education (School Day and School Year) (England) Regulations 1999

2.  In respect of the application of regulation 3(2) of the Education (School Day and School Year) (England) Regulations 1999(4) to the Schools, in relation to the 2012-2013 school year(5), for “380” substitute “378”.

Time period

3.  This Order has effect up to and including 31st August 2013.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is made under section 2 of the Education Act 2002. Article 2 provides for the number of school sessions required at West Earlham Infant School and West Earlham Junior School to be reduced from 380 to 378 in the 2012-2013 school year.

An impact assessment has not been produced for this instrument as no impact on businesses or civil society organisations is foreseen.
