The Secretary of State, having had regard to the matters specified in section 93(6) of the Environment Act 1995 (“the Act”)(1) and after consultation in accordance with section 93(2) of the Act, makes these Regulations in exercise of the powers conferred by sections 93(1) and (8) and 94(1)(b), (c) and (d), and (7) of the Act.
1. These Regulations may be cited as the Producer Responsibility Obligations (Packaging Waste) (Amendment) Regulations 2016 and come into force on 20th December 2016.
2.—(1) Schedule 2 to the Producer Responsibility Obligations (Packaging Waste) Regulations 2007 (recovery and recycling obligations)(2) is amended as follows.
(2) In paragraph 3(4)—
(a)for the formula substitute—
(b)omit the definition of “W”.
(3) In paragraph 6—
(a)omit “at the head of the subsequent columns”;
(b)for Table 2 substitute—

These Regulations amend the Producer Responsibility Obligations (Packaging Waste) Regulations 2007 (S.I. 2007/871). Those Regulations impose on producers the obligation to recover and recycle packaging waste in order to attain the recovery and recycling targets set out in Article 6(1) of European Parliament and Council Directive 94/62/EC (OJ No L 365, 31.12.94, p10). These Regulations establish new recycling targets for plastic for 2016 to 2020 and for glass for 2018 to 2020. The target for recycling by re-melt for 2016 and 2017 is continued for 2018 to 2020.
