The Secretary of State makes the following Regulations in exercise of the powers conferred by section 19B(1A), (2), (3) and (5)(a) of the Registration Service Act 1953(1).

Citation and commencement

1.  These Regulations may be cited as the Civil Registration Fees (Data-Sharing) Regulations 2018 and come into force on 6th July 2018.

Fees

2.—(1) A fee is payable for the work of civil registration officials in making a disclosure of information under section 19AA(2) of the 1953 Act.

(2) The fee is payable to the civil registration official making the disclosure.

(3) The fee is payable by the—

(a)specified public authority(3), or

(b)civil registration official,

to whom the disclosure of information is made.

(4) Where the disclosure is made by—

(a)the Registrar General, a fee of £52 per hour of work by a civil registration official applies;

(b)a civil registration official other than the Registrar General, a fee of £57 per hour of work by a civil registration official applies.

(5) A civil registration official may reduce, waive or refund part or all of any fee payable under this regulation to them on the grounds—

(a)of public interest, or

(b)that, in the opinion of the civil registration official, it is just and equitable to do so.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations provide for fees in respect of the disclosure of information by civil registration officials under section 19AA of the Registration Service Act 1953 (c. 37). That section provides that a civil registration official may disclose information held in accordance with the official’s functions to specified public authorities and to other civil registration officials.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
