The Secretary of State, in exercise of the powers conferred by sections 91 and 272(7) of the National Health Service Act 2006(1), makes the following Regulations.
1.—(1) These Regulations may be cited as the National Health Service (Performers Lists) (England) (Coronavirus) (Amendment) Regulations 2020 and come into force on 9th April 2020.
(2) These Regulations apply to England only.

2. For regulation 24(1) of the National Health Service (Performers Lists) (England) Regulations 2013(2) (medical performers list), substitute—
“(1) A medical practitioner who is not—
(a)employed by or, in the case of a locum agency, registered with a body prescribed by regulation 4 of the Medical Profession (Responsible Officers) Regulations 2010(3) (designated bodies); or
(b)granted permission, by a person managing a hospital owned or managed by such a body, to practise as a medical practitioner in that hospital,
may not perform any primary medical services unless that person is a general medical practitioner included in the medical performers list.
This is subject to paragraphs (2) to (5).”.

These Regulations substitute regulation 24(1) of the National Health Service (Performers Lists) (England) Regulations 2013 (S.I. 2013/335).
Currently medical practitioners cannot provide general medical practitioner services for the National Health Service unless they are general medical practitioners on a performers list (“the medical performers list”) maintained by the NHS Commissioning Board. These Regulations change that so that medical practitioners who are not general medical practitioners can provide such services without being on the medical performers list if they are employed by or are registered with bodies designated by the Medical Profession (Responsible Officers) Regulations 2010, or are granted permission to practise as medical practitioners in hospitals owned or managed by such bodies. These are bodies such as NHS bodies, the Department of Health and Social Care and the armed forces.
