The Secretary of State, in exercise of the powers conferred by section 21(4)(c) and (d) of the Professional Qualifications Act 2022(1), makes the following Regulations:
1. These Regulations may be cited as the Professional Qualifications Act 2022 (Commencement No. 1) Regulations 2022.
2. These regulations extend to England and Wales, Scotland and Northern Ireland.
3. The following provisions of the Professional Qualifications Act 2022 come into force on 28th October 2022—
(a)section 9 (duty of regulator to provide information to regulator in another part of the United Kingdom); and
(b)section 10 (duty of regulator to provide information to overseas regulator), in so far as it is not already in force.

These Regulations bring into force sections 9 and 10 of the Professional Qualifications Act 2022 (“the Act”).
Section 9 places a duty on a regulator in one part of the United Kingdom (“the UK”) to provide information to a regulator in another part of the UK. This duty applies when individuals entitled to practise a regulated profession in one part of the UK are seeking to practise a corresponding regulated profession in another part of the UK.
Section 10 places a duty on a regulator in the UK to provide information to a regulator overseas. This duty applies when the individual is entitled to practise a regulated profession in the UK, or a part of the UK, and is seeking to practise a corresponding regulated profession overseas. The individual concerned must have given their permission for the information to be shared.
An impact assessment has not been published for these Regulations, as they have no impact on costs to businesses, the public or voluntary sectors independent of the provision these Regulations bring into force.
