The Welsh Ministers have been designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures in the veterinary and phytosanitary fields for the protection of public health.

The Welsh Ministers make the following Regulations under the powers conferred by section 2(2) of the European Communities Act 1972.

Title, application and commencement

1.—(1) The title of these Regulations is the Transmissible Spongiform Encephalopathies (Wales) (Amendment) Regulations 2010.

(2) These Regulations apply in relation to Wales and come into force on 9 August 2010.

Amendment of the Transmissible Spongiform Encephalopathies (Wales) Regulations 2008

2.—(1) The Transmissible Spongiform Encephalopathies (Wales) Regulations 2008(3) (“the principal Regulations”) are amended in accordance with paragraph (2).

(2) For paragraph 4(3) of Schedule 2 to the principal Regulations, substitute—

“4— (3) An “approved testing laboratory(labordy profi cymeradwy)” means—

(a) a laboratory approved under this paragraph;

(b) a laboratory approved under corresponding legislation elsewhere in the United Kingdom;

(c) an EU National Reference Laboratory; or

(d) a diagnostic laboratory approved by a member State in accordance with Annex X to the Community TSE Regulation.”.

Explanatory Note

(This note is not part of these Regulations)

These Regulations amend the Transmissible Spongiform Encephalopathies (Wales) Regulations 2008, S.I. 2008/3154 (W.282) (“the principal Regulations”) which enforce Regulation (EC) No 999/2001 of the European Parliament and of the Council laying down rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies (OJ No L 147, 31.5.2001, p.1) as amended.

Under the principal Regulations, slaughterhouse operators are required to submit samples from cattle to an approved laboratory for TSE testing. These Regulations expand the definition of an “approved laboratory” in the principal Regulations. The amendment will enable slaughterhouse operators (if they so choose) to send brain stem samples from cattle to a European Union National Reference Laboratory for TSE testing or to laboratories approved by the competent authority in another Member State of the European Union.

A regulatory impact assessment has not been prepared as the effect of this instrument on the costs of business is negligible.
