This Order is made by the Welsh Ministers, in exercise of the power conferred upon the National Assembly for Wales by paragraph 8(1) of Schedule 8 and paragraph 3(1) of Schedule 10 to the Traffic Management Act 2004(1) and now vested in them(2).

Rhondda Cynon Taf County Borough Council has applied to the Welsh Ministers for an Order to be made under these powers with respect to part of its area.

The Welsh Ministers have consulted the chief officer of the South Wales Police in accordance with the requirements of paragraph 8(3) of Schedule 8 and paragraph 3(4) of Schedule 10 to the Traffic Management Act 2004.

Title, commencement and application

1.—(1) The title of this Order is the Civil Enforcement of Parking Contraventions (County Borough of Rhondda Cynon Taf) Designation Order 2012.

(2) This Order comes into force on 1 August 2012 and applies in relation to Wales.

Designation of civil enforcement area and special enforcement area

2.  The Welsh Ministers designate the area described in the Schedule as—

(a) a civil enforcement area for parking contraventions; and

(b) a special enforcement area.

Article 2

SCHEDULE Area designated as a civil enforcement area for parking contraventions and a special enforcement area.

This Order applies to the whole of the County Borough of Rhondda Cynon Taf with the exception of—

(a) that length of the A465 from the boundary with the County Borough of Merthyr Tydfil at a point approximately 15 metres east of its junction with the B4276 Merthyr Road, to the boundary with the County Borough of Neath Port Talbot at a point approximately 1809 metres east of the westbound Glynneath off-slip;

(b) that length of the A470 from the boundary with the City and County of Cardiff at a point approximately 237 metres north of the centre of the A470/A4054/ B4262 Ynys Bridge roundabout, Taffs Well, to the boundary with the County Borough of Merthyr Tydfil at a point approximately 220 metres south of the Goitre-Coed Road overbridge.

Explanatory Note

(This note is not part of the Order)

This Order designates the area described in the Schedule as a civil enforcement area and a special enforcement area for the purposes of Part 6 of the Traffic Management Act 2004. The practical effect of the Order is to enable the Council of the County Borough of Rhondda Cynon Taf to enforce parking contraventions within the area described in the Schedule to the Order through a civil law regime, as opposed to enforcement by police or traffic wardens in a criminal law context.

The functions of the National Assembly for Wales under the Traffic Management Act 2004 were transferred to the Welsh Ministers by virtue of section 162 of and paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (2006 c. 32). By virtue of section 92 of the Traffic Management Act 2004, the National Assembly for Wales was designated as the appropriate national authority as regards Wales, for the purposes of Part 6 of that Act.
