The Monmouthshire (Communities) Order 2021

Coming into force in accordance with article 1(2) and (3)

The Local Democracy and Boundary Commission for Wales(1) has, in accordance with sections 54(1) and 58(1) of the Local Government Act 1972(2) (“the 1972 Act”), submitted to the Welsh Ministers a report dated January 2019 containing its recommendations for change and the details of a review of community arrangements within the County of Monmouthshire conducted by Monmouthshire County Council.

The Welsh Ministers have decided to give effect to the Commission’s recommendations without modification.

In accordance with section 58(2) of the 1972 Act, more than 6 weeks have elapsed since those recommendations were submitted to the Welsh Ministers.

The Welsh Ministers make the following Order in exercise of the powers conferred on the Secretary of State by sections 58(2), 67(4) and (5) of the 1972 Act(3), and now vested in them, so far as exercisable in relation to Wales(4).

Title and commencement

1.—(1) The title of this Order is the Monmouthshire (Communities) Order 2021.

(2) For any purpose set out in regulation 4(1) of the Regulations, this Order comes into force on 8 November 2021.

(3) For all other purposes, this Order comes into force at 23:59 hours on the day before the ordinary day of election of councillors in 2022(5).

Interpretation

2.—(1) In this Order—

electoral ward” (“ward etholiadol”) means any area for which councillors are elected to Monmouthshire County Council;

existing” (“presennol”), in relation to a local government or electoral area, means that area as it exists immediately before the time and day set out in article 1(3);

new” (“newydd”), in relation to a local government or electoral area, means that area as established by this Order;

the Regulations” (“y Rheoliadau”) means the Local Government Area Changes Regulations 1976(6);

any reference to a map means one of the 166 maps marked “Map of the Monmouthshire (Communities) Order 2021”, deposited in accordance with regulation 5 of the Regulations, labelled “1” to “166”, and a reference to a numbered map is a reference to the map that bears that number;

where a boundary is shown on a map as running along a road, railway line, footway, watercourse or similar geographical feature, it is to be treated as running along the centre line of the feature;

words and expressions used in this Order have the same meaning as they have in the Local Government Act 1972 as saved, except so far as a contrary intention appears.

(2) The provisions in this Order take precedence over any conflicting provision in any previous statutory instrument made under section 58(2) of the 1972 Act or order made under sections 37(1), 38(1) or 39(1) of the Local Government (Democracy) (Wales) Act 2013(7).

Llantilio Crossenny — dissolution of community of and consequential change to community council

250.—(1) The existing community of Llantilio Crossenny as changed by this Order is dissolved.

(2) The community council of Llantilio Crossenny is dissolved.

Initial expenses etc of new community councils

251.—(1) In this article—

the 1992 Act” (“Deddf 1992”) means the Local Government Finance Act 1992(8);

the new community” (“y gymuned newydd”) means the appropriate community area of the new community councils established by this Order;

the new community councils” (“y cynghorau cymuned newydd”) means the new community councils established by this Order;

the prospective billing authority” (“yr awdurdod bilio arfaethedig”) means Monmouthshire County Council;

the relevant financial year” (“y flwyddyn ariannol berthnasol”) means the financial year beginning 1 April 2022.

(2) In relation to the relevant financial year, section 32 of the 1992 Act (calculation of budget requirements by billing authorities) applies to the new community councils and the prospective billing authority but as if—

(a)for the purposes of making a calculation in accordance with section 32(2)(a) of the 1992 Act—

(i)the amount notified in accordance with paragraph (6) of this article were an item mentioned in section 35(1) of the 1992 Act (special items) relating to the new community, and

(ii)the area of the prospective billing authority included the new community.

(b)subsection (6) were omitted.

(3) In relation to the relevant financial year, section 41 of the 1992 Act (issue of precepts by local precepting authorities) applies to the new community councils and the prospective billing authority but as if the prospective billing authority, in making calculations in accordance with section 32 of the 1992 Act (originally or by way of substitution) for the purposes of its estimate under section 32(2)(a) of the 1992 Act, were required to take into account an amount equal to that notified to it in accordance with paragraph (6) of this article.

(4) In relation to the relevant financial year, sections 52X(1) (calculations to be net of precepts) and 52Y(2) (information for purposes of Chapter 4A) of the 1992 Act apply to the new community councils and the prospective billing authority but as if the aggregate amount of precepts anticipated by the prospective billing authority in pursuance of regulations made under section 41 of the 1992 Act included the amounts notified to the new community councils in accordance with paragraph (6) of this article.

(5) In relation to the relevant financial year, section 50 of the 1992 Act (calculation of budget requirement by local precepting authorities) applies to the new community councils and the prospective billing authority as if each of the new community councils were required to secure that the amount calculated as its budget requirement for that year does not exceed the amount notified to that new community council in accordance with paragraph (6) of this article.

(6) The appropriate amount to be notified to each of the new community councils in accordance with this paragraph, must be notified by the Welsh Ministers in writing to the prospective billing authority and to each of the new community councils.

(7) In relation to the relevant financial year, the Local Authorities (Precepts) (Wales) Regulations 1995(9) apply to the new community councils and the prospective billing authority as if—

(a)regulation 5 (information on schedules of payment) were omitted;

(b)in paragraph 8 of the Schedule (rules for determination of schedules in instalments)—

(i)in sub-paragraphs (1), (2) and (3), the words after the first reference to “that financial year” were omitted;

(ii)in sub-paragraph (1)(a), the reference to “April” were a reference to “May”.

New community councils

252.  The proper officer of Monmouthshire County Council must convene the first meeting of each of the new community councils established by articles 137, 157, 232 and 246.

New community councils — residuary successors

253.  For the purposes of any provision of the Regulations which refers to the residuary successor of a dissolved authority—

(a)in relation to the existing community councils of Llangwm and Llantrisant Fawr, the council of the new community of Llantrisant Fawr is specified as the residuary successor;

(b)in relation to the existing community councils of Llangybi and Llanhennock, the council of the new community of Llangybi is specified as the residuary successor.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order, made in accordance with section 58(2) of the Local Government Act 1972, implements the proposals of the Local Democracy and Boundary Commission for Wales (“the Commission”), which reported in January 2019 on a review of community arrangements in the County of Monmouthshire conducted by Monmouthshire County Council. The Commission’s Report recommended changes to the existing boundaries of communities within the area of Monmouthshire County Council and consequential changes to electoral arrangements, and this Order implements the Commission’s recommendations without modification.

The effect of this Order is to make changes to a number of community areas and consequential changes to electoral arrangements. This Order also dissolves a number of communities and their community councils, creates new communities and new community councils and makes administrative provision for the operation of, and setting of precepts relating to, those new community councils.

The Local Government Area Changes Regulations 1976 referred to in article 2 of this Order contain incidental, consequential, transitional and supplementary provisions about the effect and implementation of orders such as this.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this Order.

Prints of the maps labelled “1” to “166” to which this Order relates are deposited in the office of the Welsh Government at Cathays Park, Cardiff, CF10 3NQ (Local Government Democracy Division), and with Monmouthshire County Council. Prints deposited with Monmouthshire County Council are open to inspection by anyone affected by the provisions of this Order.

The Local Government Boundary Commission for Wales was established by section 53 of, and Schedule 8 to, the Local Government Act 1972 (c. 70) (“the 1972 Act”). Section 53 and Schedule 8 were repealed by section 73(2) of, and Schedule 2 to, the Local Government (Democracy) (Wales) Act 2013 (anaw 4) (“the 2013 Act”). The 2013 Act re-names the Local Government Boundary Commission for Wales as the Local Democracy and Boundary Commission for Wales (see section 2).

The Local Authorities (Change to the Years of Ordinary Elections) (Wales) Order 2019 (S.I. 2019/1269 (W. 220)) amends section 26(1) of the 1972 Act to provide that the year in which the ordinary elections of councillors of local authorities shall take place is 2022 instead of 2021.
