3Personau a gwasanaethau na chaniateir gosod ffioedd ynglŷn â hwy

(1)Caiff Gweinidogion Cymru drwy reoliadau wneud darpariaeth sy'n pennu categorïau o berson, gwasanaeth y caniateir codi ffioedd amdano neu gyfuniadau o wasanaethau y caniateir codi ffioedd amdanynt (neu gategorïau o berson o ran gwasanaeth neu gyfuniadau o wasanaethau penodol) y mae'n rhaid peidio â gosod ffi ynglŷn ag ef neu hwy o dan adran 1.
(2)Mae'r ddarpariaeth y caniateir ei gwneud yn y rheoliadau yn cynnwys darpariaeth (ond nid yw'n gyfyngedig i hynny)—
(a)sy'n pennu categorïau o berson drwy gyfeirio at hawl y person hwnnw neu berson arall i gael neu dderbyn taliadau penodedig, cyfleusterau, gwasanaethau neu fuddiannau mewn da;
(b)sy'n pennu categorïau o berson drwy gyfeirio at eu hoedran neu eu hanghenion;
(c)sy'n pennu categorïau o wasanaeth neu gyfuniadau o wasanaethau drwy gyfeirio at y cyfnod o amser pan ddarperir ef neu hwy.
(3)Yn unol â hynny, nid yw adrannau 4 i 12 yn gymwys i—
(a)gwasanaethau neu gyfuniadau o wasanaethau a bennir mewn rheoliadau o dan is-adran (1), neu
(b)gwasanaethau a dderbynnir gan bersonau a bennir felly.
