SCHEDULE 1AMENDMENTS

The Police Act (Northern Ireland) 1970(c. 9)

In section 17 for subsections (1A) and (1B) substitute—

(1A) The Police Association may represent a member of the police force at any proceedings brought under regulations made in accordance with section 25(3) or 26(3) or on an appeal from any such proceedings.

(1B) Except on such an appeal or as provided by regulations made as mentioned in subsection (1A), a member of the police force may only be represented under subsection (1A) by another member of the police force..

In section 21(3) for the words from “shall, for the purposes” to “Regulations accordingly” substitute “may be dealt with under regulations made in accordance with section 25(3) for anything done or omitted while he was engaged in service in another United Kingdom police force as if that service had been in service in the Royal Ulster Constabulary, and regulations made in accordance with section 25(4) shall apply accordingly”.

In section 28(1) for “for disciplinary offences” substitute “in disciplinary proceedings”.

The Police and Criminal Evidence (Northern Ireland) (Order 1989 (NI 12)

In Article 2(5) for “paragraph (4)” substitute “this Order”.

In Article 47 for paragraph (4) substitute—

(4) Where—

(a)in case to which paragraph (2) applies, the day next following the day on which the person is charged with the offence; or

(b)in case to which paragraph (3) applies, the day next following the day of the person’s arrival in the petty sessions district in question,

is Christmas Day, Good Friday or a Sunday, he shall be brought before a magistrates' court not later than the next following day which is not one of those days..

In Article 87(3) for “paragraphs (4) and (5)” substitute “paragraph (4)”.

Schedule 2 shall have effect and be deemed always to have had effect with the insertion at the appropriate place of the following entry—
