The Scottish Ministers, in exercise of the powers conferred by section 10(8), (8A) and (9) of the Family Law (Scotland) Act 1985(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:
1985 c. 37; section 10(8) was substituted by the Welfare Reform and Pensions Act 1999 (c. 30) (“the 1999 Act”), Schedule 12, paragraph 8(3); section 10(8A) was inserted by the 1999 Act, Schedule 12, paragraph 8(4). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46) as read with section 91(4) of the 1999 Act which deemed paragraphs 8(3) and (4) of Schedule 12 to the 1999 Act to be pre commencement enactments within the meaning of the said 1998 Act.
