The Civil Courts (Amendment) Order 1984

The Lord Chancellor, in exercise of the powers conferred on him by section 99(1) of the Supreme Court Act 1981; by section 29(1) of the Administration of Justice Act 1982; by section 1(1) of the Matrimonial Causes Act 1967; by section 55 of the County Courts Act 1959; by section 96 of the Bankruptcy Act 1914 and section 218(5) of the Companies Act 1948; and by section 67(1) and (2) of the Race Relations Act 1976, hereby makes the following Order:—

1.  This Order may be cited as the Civil Courts (Amendment) Order 1984 and shall come into operation on the 1st April 1984.

District Registries of the High Court

2.  The district registry of the High Court at Newtown shall be closed.

3.  A district registry of the High Court shall be established at Welshpool.

4.  The district of the Reigate County Court shall be assigned to the district of the Guildford District Registry.

County Courts

5.—(1) The holding of the Newtown County Court shall be discontinued.

(2) The county court at Welshpool shall have jurisdiction in proceedings commenced in the Newtown County Court before this Order comes into operation and shall be named the Welshpool and Newtown County Court.

(3) No process shall be invalid only because the court is described therein by the name by which it was known before the coming into operation of this Order.

6.  The Bloomsbury and Marylebone County Court shall be renamed the Bloomsbury County Court.

7.  For the purposes of section 1(1) of the Matrimonial Causes Act 1967 the Llangefni County Court shall be a divorce county court and court of trial.

8.  For the purposes of section 96(2) of the Bankruptcy Act 1914 and of section 218(5) of the Companies Act 1948 the Welshpool and Newtown County Court shall not be excluded from having jurisdiction under those Acts.

9.  For the purposes of section 67(1) and (2) of the Race Relations Act 1976 the district of the Welshpool and Newtown County Court shall be assigned for race relations purposes to the Wrexham County Court.

10.  The amendments set out in the schedule to this Order shall be made to the Civil Courts Order 1983, being amendments that are consequential upon the foregoing provisions of this Order.

SCHEDULEConsequential Amendments

The Civil Courts Order 1983 shall be amended as follows—

(1)

in schedule 1:—

(a)

after the entry relating to Warrington there shall be inserted the following new entry:

(b)

the entry relating to the Newtown District Registry shall be deleted; and

(c)

“Reigate” shall be inserted in its appropriate alphabetical position in the second column opposite the entry for Guildford in the first column.

(2)

in schedule 3:—

(a)

the word “Divorce” shall be inserted in the second column opposite the entry for Llangefni in the first column;

(b)

the entry relating to the county court at Newtown shall be deleted;

(c)

the letters “D.R.” shall be inserted in the first column beneath the entry for Welshpool;

(d)

the word “Bankruptcy” shall be inserted in the second column opposite the entry for Welshpool in the first column and the word “Newtown” in the fourth column thereof shall be deleted; and

(e)

the word “Wrexham” shall be inserted and the word “Birmingham” shall be deleted in the fifth column opposite the entry for Welshpool in the first column.

(3)

in schedule 4:—

(a)

paragraph 6 shall be deleted;

(b)

after the entry numbered 15 (for Reigate)the words, “The name of the county court at Welshpool shall be the Welshpool and Newtown County Court” shall be inserted; and

(c)

the new entry for Welshpool shall be numbered 16 and the existing entry numbered 16 shall be re-numbered 17.

EXPLANATORY NOTE

This Order amends the Civil Courts Order 1983 by:

(a) transferring the district registry of the High Court at Newtown to Welshpool on the closure of the county court at Newtown;

(b) closing the county court at Newtown;

(c) assigning the district of the Reigate County Court to the Guildford District Registry;

(d) designating the Llangefni County Court as a divorce court and court of trial;

(e) granting jurisdiction in bankruptcy and winding-up of companies to the Welshpool and Newtown County Court;

(f) changing the name of the Bloomsbury and Marylebone County Court and the Welshpool County Court; and

(g) transferring the assignment of the district of the Welshpool and Newtown County Court from the Birmingham County Court to the Wrexham County Court for race relations purposes.
