COUNTY COURTS SUPREME COURT OF ENGLAND AND WALES

The Civil Courts (Amendment No. 3) Order 1986

The Lord Chancellor, in exercise of the powers conferred on him by section 2(1) of the County Courts Act 1984 and by section 99(1) of the Supreme Court Act 1981, hereby makes the following Order:—

1.  This Order may be cited as the Civil Courts (Amendment No. 3) Order 1986 and shall come into operation on 31st January 1987.

2.  The holding of the Hyde County Court shall be discontinued.

3.  The Ashton-under-Lyne and Stalybridge County Court shall be known as the Tameside County Court and shall have jurisdiction in proceedings commenced in the Hyde County Court before this Order comes into operation.

4.  No process shall be invalid only because the court is described therein by the name by which it was known before the coming into operation of this Order.

5.  The amendments set out in the Schedule to this Order shall be made to the Civil Courts Order 1983(1), being amendments that are consequential upon the foregoing provisions of this Order.

Article 5

SCHEDULECONSEQUENTIAL AMENDMENTS

The Civil Courts Order 1983 shall be amended as follows:—

(1)

in Schedule 1:—

(a)

in the second column opposite the entry relating to Oldham District Registry the words “Ashton-under-Lyne and Stalybridge” shall be deleted and after the word “Oldham” shall be inserted the word “Tameside”;

(b)

in the second column opposite the entry relating to Stockport the word “Hyde” shall be deleted.

(2)

in Schedule 3:—

(a)

the entry relating to Ashton-under-Lyne shall be removed from its present position and inserted after the entry relating to Swindon, and for the words “Ashton-under-Lyne” shall be substituted the word “Tameside”;

(b)

the entry relating to Hyde shall be deleted;

(3)

in Schedule 4:—

(a)

the entry numbered 2 (for Ashton-under-Lyne) shall be deleted;

(b)

the existing entries numbered 3 to 15 shall be renumbered 2 to 14 respectively.

EXPLANATORY NOTE

This Order closes Hyde County Court and transfers its district to the jurisdiction of the Ashton-under-Lyne and Stalybridge County Court which is renamed the Tameside County Court.
