In exercise of the powers conferred on me by section 29(2) of the Criminal Justice (International Co-operation) Act 1990(1), I hereby make the following Order:

1.  This Order may be cited as the Criminal Justice (International Co-operation) Act 1990 (Detention and Forfeiture of Drug Trafficking Cash) Order 1991 and shall come into force on 2nd September 1991.

2.  For the purposes of section 25(1) of the Criminal Justice (International Cooperation) Act 1990 (power to seize and detain drug trafficking money imported or exported in cash) the prescribed sum shall be £10,000.

Explanatory Note

(This note is not part of the Order)

This Order prescribes the sum of £10,000 for the purposes of section 25 of the Criminal Justice (International Co-operation) Act 1990, which provides for the seizure and detention and forfeiture of cash suspected to be the proceeds of drug trafficking or intended for use in drug trafficking. The powers will apply only to cash amounts of £10,000 and above (including their equivalent in currency other than sterling). Cash seized under section 25 may be ordered to be forfeited by a magistrates' court or in Scotland the sheriff.
