The Secretary of State, in exercise of the powers conferred upon him by sections 18(1)(c) and 24 of the Lotteries and Amusements Act 1976(1), hereby makes the following Order:
1.—(1) This Order may be cited as the Amusements with Prizes (Variation of Monetary Limits) (Scotland) Order 1996 and shall come into force on 27th January 1997.
(2) This Order shall extend to Scotland only.
2. In section 16(3) of the Lotteries and Amusements Act 1976 (conditions on which the provision of amusements is permitted at certain commercial entertainments) paragraph (c) shall have effect as if, for the sum of 10p(2) specified in that paragraph, there were substituted the sum of £5.
3. In article 2 of the Amusements with Prizes (Variation of Monetary Limits) (Scotland) Order 1984(3)–
(a)for the words “Paragraphs (a) and (c)” there shall be substituted the words “Paragraph (a)”;
(b)in paragraph (a) the words “(a) in paragraph (a),” shall be omitted; and
(c)paragraph (c) shall be omitted.

This Order increases from 30p to £5 the maximum amount permitted to be offered as a money prize in amusements with prizes provided at certain fairs and other commercial entertainments under section 16 of the Lotteries and Amusements Act 1976.
Section 16(3) has effect as if, for the sum of 10p specified in that subsection, there were substituted the sum of 30p by virtue of Article 2(c) of the Amusements with Prizes (Variation of Monetary Limits) (Scotland) Order 1984 (S.I. 1984/465).
