The Secretary of State makes the following Regulations in exercise of the powers conferred upon him by sections 41(1), (2) and (5) of the Road Traffic Act 1988 (1).
In accordance with section 195(2) of that Act, he has consulted with representative organisations.
1. These Regulations may be cited as the Road Vehicles (Construction and Use) (Amendment) Regulations 2006 and shall come into force on 1st August 2006.
2.—(1) Schedule 7B to the Road Vehicles (Construction and Use) Regulations 1986 (2) shall be amended as follows.
(2) In paragraph 7, for sub-paragraph (b) there shall be substituted the following sub-paragraph—
“(b)“the emissions publication” is the publication entitled “In Service Exhaust Emission Standards for Road Vehicles – Twelfth Edition” (ISBN 0-9549352-1-7 on or before 31st December 2006 and from 1st January 2007 ISBN 978-09549352-1-4) published by the Department for Transport.”

These Regulations further amend the Road Vehicles (Construction and Use) Regulations 1986 (“the 1986 Regulations”).
Regulation 2 amends the definition of “the emissions publication” in Schedule 7B of the 1986 Regulations so as to refer to the most recent (i.e. the twelfth) edition of the publication entitled “In Service Exhaust Emission Standards for Road Vehicles”. The publication contains in-use emissions limits that petrol-engined cars and light vans are required to meet at MoT and roadside emissions tests. The publication updates new models of petrol-engined passenger cars and light commercial vehicles, which have come onto the market since the last amending regulations came into effect on 1st August 2005, and also revises a small amount of data on existing models. The ISBN number of the publication will change on 1st January 2007, due to a change in the ISBN numbering system. However, the publication itself will not change.
A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
