The Secretary of State for Health makes the following Regulations in exercise of the powers conferred by sections 153(2) and (5), and 195(1) and (2) of the Health and Social Care (Community Health and Standards) Act 2003(1).
In accordance with section 195(3) of that Act, the Secretary of State for Health has consulted the Welsh Ministers(2).
2003 c.43; section 153 was amended by section 73 of the Health Act 2006 (c.28). By section 167(1), the powers are exercisable in relation to England and Wales by the Secretary of State. See section 168 for the definition of “prescribed”.
Functions conferred or imposed on the National Assembly for Wales by an enactment contained in an Act were transferred to the Welsh Ministers by paragraph 30(2) of Schedule 11 to the Government of Wales Act 2006 (c.32).
